Hi all. I just received all of my return receipts from validations today. Now I'm ready to dispute with CRA's. Should I dispute online or by CRRR?
Its a personal choice. I like CRRR because you have a chance at them not completing in 30 days Got lots of deletions once that way.
Concur. Go CRRR. Judges prefer it when you can easily reference your notices of dispute with a green card. The online disputes can become "lost" due to computer error. BTW, I'm definitely down with the user name. Clever.
I've gone with both, and, in addition, I have sent "under the radar" letters non-CRRR. These only worked when I originally started. The online thing worked as often as the CRRR with possibly the exception of EX. But if you plan to go for the litigation, CRRR is probably your only way. IMHO
I have not had as much luck with online disputes as I have w/ CRRR. If you do opt to go the online route I suggest that you print all copies of confirmation screens. There are a couple of very important reasons for doing this: 1. You have documented proof that an investigation was in fact requested, this is especially helpful if the CRA violates the FCRA and you decide to take your case to court. 2. If the CRA violates the FCRA by not conducting and completing the investigation within the amount of time prescribed by law ( which happens to be one of the most frequent legal infractions perpetrated by CRA's ) then when you send your " last chance before court" letter or "Intent to Sue letter" within that letter you can refer to your prior correspondences with Registered mail numbers ( keep your receipts! ) This makes your "last chance" letter a lot more belivevable, and it increases the likelyhood that the CRA with delete or revise the tradeline for fear of legal action. Once I got a deletion on a pure bluff. I called EQ's CSC in El Paso legitimately thinking they had failed to respond in the 30 days. I asked for a supervisor and politely told her I was owed a deletion. While she was looking at my file, I was thumbing through my paperwork for EQ. In the middle of it was a response from EQ on the account I was complaining about. They has responded inside 10 days of the CRRR. She still took it off, thinking they had screwed up. I'll take 'em where I can get 'em!
