Open checking pull credit!!!!!!!!!!

    What state are you in? I'm in CA, so because Wells Fargo has a majority of marketshare in CA, it may have tighter restrictions on the accounts that we open in CA. If you're in another state, it is possible that we have looser requirements for opening accounts in those states. (Don't know for sure, never worked for Wells Fargo outside of CA.)

    The first part may be true, but the part about being required to pull a credit report in order to be regulatory compliant I suspect is bullsh**. Ok, David, what regulation requires it?

    I think if you take a closer look at David's post you will find he is saying W.F. is required to inform the customer of the credit pull to be regulatory compliant;
    not that they have to make the pull to be regulatory compliant.

    So pulling a hard inquiry to open a deposit account is NOT a regulatory requirement as you said before. If it was, what State I'm in would be irrelevant. FYI I am in Arizona. This lawsuit looks better and better with each post you make. They will be introduced as evidence, Thanks for the ammo.

    He never said that pulling a hard was a regulatory requirement, as SEVERAL people have ALREADY pointed out. The regulatory requirement was that they TELL you that they're pulling your credit.

    And state would indeed, make a difference, as each state has its own banking regulations in addition to the federal regulations. Hence why each state has its own Department of Banking and Finance (of course called different things in each state.)

    There's no reason to attack him, sheesh. He didn't pull your credit report.

    As for your lawsuit, are you sure that you have a leg to stand on?

    I would contend that your relationship with your bank is one that arises out of a business transaction (you write on a piece of paper, and they dispense money in exchange; they hold your money for you until such time as that piece of paper is presented or you withdraw it in some manner) and it was initiated by you (you went into the bank and filled out the application and signed the forms - one of which likely said that they were going to pull your credit - and gave them your money to hold.) The paper that you signed is considered a contract (again, for them to hold your money and dispense it as outlined above) and that is a business transaction.

    By your definition of a business transaction

    (a) the convenience store has the right to pull your credit file every time you buy a twinkie from them

    (b) your bank has a right to pull your credit file every time you make a deposit or a withdrawal

    (c) the list of business transactions that entitle a company to pull your credit file will never end.

    With each "pull" your FICO goes down, making you look like a worse credit risk. I can just see the future:

    "Gee, Mr. Jones, I can't sell you that Twinkie because in the last week you went to the movies, bought gasoline, ate a Snickers Bar at a different Convenience Store, got a haircut and had your taxes done. Those inquiries lowered your FICO score below or company thressholds for new customers."

    No, see, there you go again, reading things that just aren't there and jumping to conclusions right into the great abyss of idiocy.

    When you opened your checking account, you applied to do so. Then, you signed a contract. You asked the bank to believe that you behave responsibly when dealing with your finances. One way for them to verify that you're telling the truth is to check your credit report. Many bounced checks end up as collection items. Hell, Equifax has or had a collection division that deals solely with bounced checks.

    Unless your convenience store is way different from mine, I don't apply for, nor do I sign a contract to buy a Twinkie. Getting your credit checked to complete a transaction with a merchant is ludicrous; getting your credit checked when you ask the bank to believe that you won't present more pieces of paper for payment than you have money for is sound business practice on the part of the bank.

    BTW, Amy B, watch the part where he's in France and they finally handcuff him. The french police officer is the REAL FRANK ABAGNALE! Just verified it with the credits and the Special Feature DVD.

    This may sound like a dumb question, but are you saying that I could sue companies for unauthorized checks of my credit? The reason I ask is that Capitol One has checked my credit report every month for the last 10 months and then have sent me a preapproval letter after each check.

    I too filed for Chapter 13 five years ago. I am having trouble getting my CR straighten out. I've written the CRA's 3 times...once after a cc was denied and twice when I was denied a mortgage. Equifax, the biggest offender in my case, hasn't fixed their errors and I am considering a law suit...since they have at least 18 things that are wrong on the report. I have established my credit once again and have nothing negative on my report since the bankruptcy in 1998. I don't know if I have grounds for a lawsuit, but I have sent documentation for them to fix the errors on my report with no luck.

    The decision on whether you can sue Cap One for an unauthorized pull of your credit file is determined on whether it is a "hard" pull or a "soft" one. Only Hard pulls affect your FICO. To hard Pull, a creditor needs a permissible purpose - and this is defined by Fair Credit Reporting Act. A soft pull does not affect your FICO and is not actionable under FCRA. It may be actionable under Graham-Leachey-Bliley Privacy act though......

    Thanks for such a rapid response. I don't know if they are hard or soft pulls. I am pretty clueless. What is the difference? I just know it made me very uncomfortable to see so many inquiries by them. It's too funny though. I don't want a card from them so I started shredding their letters, envelope and all, immediately upon receipt. Now they are sending me "unmarked" envelopes, so that I have to open them. I am beginning to feel harassed!! :) JK. I wish a home mortgage would pursue me with as much persistence!

    MY experience with cap1 is that they are soft pulls. Experian shows the difference and I must have 3 dozen Cap1 soft pulls and no hard pulls.
