i want to send this letter to the CRA's but need to get opinions before I do. (I am a newbie) *********** Dear Sir/Madame: This letter is a formal complaint that you are reporting inaccurate and incomplete credit information. The following information needs to be investigated. I respectfully request to be provided proof of this alleged item, specifically the contract, note or other instrument bearing my signature. Failing that, the item must be deleted from the report as soon as possible: Account #XXXXXXXXXXX Allegedly opened: 11/1/1987 Balance: N/A Notation in credit file: Account included in bankruptcy The listed item is completely inaccurate and incomplete, as I do not recall opening an account with Macyâ??s and I have never filed for bankruptcy. This is a very serious error in reporting. Please delete this misleading information, and supply a corrected credit profile to all creditors who have received a copy within the last 6 months, or the last 2 years for employment purposes. Additionally, please provide the name, address, and telephone number of each credit grantor or other subscriber. Under federal law, you have thirty (30) days to complete your re-investigation. Be advised that the description of the procedure used to determine the accuracy and completeness of the information is hereby requested as well, and is to be provided within 15 days of the completion of your re-investigation. ********** Will this work? Am I setting my friend up for them to come after him? The last activity on the account is his ex-wife's BKR. Prior to the BKR being added, the last activity/report date was 9/5/97 so...this would be ready to come off in 2 years, right? Now it is reaging by 2 more years since her BKR. He was in the service and she had POA and opened quite a few accounts in his name. Not to mention he came home and found out that she purchased a home!! So he had not seen his credit report during the marriage at all. Had NO idea that she was using the POA to open CC accounts all over the place. Even the signature on the mortgage has her signature with the notation of "attorney in fact for xxxxxx." He never used this card and I am wondering if he can get it deleted due to them not being able to validate it. Another questions is this. Macy's seems to be reporting this directly so should this letter go to them, or to the CRA? thanks
Whoa Cali!!!! Is this the same friend you mentioned yesterday and we all said validate and ask for continuance? If so, you really should have mentioned the POA. I will say that your friend facing a lawsuit over an account opened by his spouse with his POA does not need a message board. He desparately needs a lawyer yesterday. I would not write a letter to anybody until I had legal advice.
