I just received a phone call from someone at a CA who I had sent a request to in October. The request was delivered to them on 10/3/3. I sent a 2nd letter (this time with a 15 day deadline instead of 30) which was delivered on 1/10/4. (I know, I should have sent it sooner.)

Today is the first response I had received. The rep said he was calling about my account with xxxxx and in response to the letters they had received. He said they sent requested from the OC an 'itemized statement' on 12/8 and received it a month later. They sent it, but to an old address of mine. (I moved 11/1. All mail has been forwarded this far, but have never received correspondence from this co.) He says they sent a collection notice out after receiving my most recent letter, but I haven't received that either. He says they'll resend the itemized statement, I should have it in a month.

That's about all the conversation consisted of. He never asked for payment, I never admitted to the debt, only to having sent the letters, and not having received a response.

They are way beyond the original 30 days, but I assume if they can validate, there's no timeframe (except perhaps SOL) which limits them so long as theyh don't attempt to collect before validating. Correct?

Anyone have thoughts on this call? I'll wait to see if they send this statement out, and I'm fairly sure it won't be what I asked for (validation including the original signed document). That puts me back at the letter writing stage again. I'm still waiting for a response from transunion to see if they've upheld my dispute on this one.

Again, any thoughts would be appreciated.

FWIW, this debt was created in TX, I now live in IL, and the CA is from another state all together. I believe the debt in question is about 2 years old.

This debt is one where the contract said I was to get certain features/bundles of minutes on a cell phone, but when the bills came, every month for abt 4 months I was having to call because I didn't get those. The last month, the OC said 'sorry, these features can't all be placed on one account. I'm removing those, you'll have to pic a new plan. I refused, canceled the account, they're trying to charge ETF on the contract, I'm saying they didn't provide what the contract said. I think if it comes down to the CA actually providing the contract and itemized listings, I can show that I didn't get what I was sold.

    Thanks for your opinions.
