opinions re:impermissible inquiry

    I bought a new car last week. On June 21st the dealer pulled my equifax report to get me approved for financing, which they did with Nissan Motors. Today I see that Nissan Motors pulled a hard one this morning. I called the dealership, who gave me the ph # to Nissan.

    Nissan doesn't even show an acct in my name yet, but are denying they pulled it. They are trying to blame it on the dealer. If it was the dealer, it would show as the dealer like the last one does.

    So, I called back to the dealer, who then informed me that Nissan probably pulled it to make sure that the dealer paid off my old acct before setting up my new acct.

    Never was I told that they would pull another inquiry for this reason. Couldn't they have coded it as an acct review rather than a hard one?

    What do you guys think? I am really ticked over this.

    If the two car loan INQs were pulled during the same 2 weeks, it really makes no difference.

    In your case, there's a borderline interval.

    Yes, I know it will or is supposed to count as only 1. My point is that no one either at the dealership or from Nissan said they would pull another or asked permission to pull another. It is exactly 14 days from the first inquiry to the second inquiry. It's just the point that it was done without notice. It didn't affect my score at all.

    LKH: I'd keep going up the ladder till I got to someone to remove it. If not, the BBB and a certified letter to the corporate office. (I did have to do just this was an Allstate situation just the same.)

    P.S. I love my Nissan..hope you do as well!

    Since this is now your current car lender, they can do anything they want to regarding pulls. Nissan pulled it (not the dealer) and Nissan is your lender now... they can do it 365 if they want to.

    However, you do have an ethical issue in that a HARD pull connotes a NEW application for credit, this is an account review.

    Have them recode it as soft or better yet, just remove it. Any normal person understands, 1 loan usually is 1 inquiry.

    However, if push comes to shove they have permissible purpose as a current creditor. If you had then gone with another lender, you'd have them because they would have no reason to be in your record (no continuing credit obligation).

    You know these tick me off, though... so I feel for you. But in the grand scheme of it all, 1 inquiry won't kill you. If you can't get it off just enjoy the car and forget about it.

    You know... I jsut reread your post. Did Nissan pull your credit on the 21st? or did the dealer only pull it? You have to expect at min that the dealer will pull it once and the company who buys the loan (Nissan) will pull it too. When you do dealer financing... you always get at least 2 pulls if not more.

    I'm guessing since you're mad that Nissan pulled it on the 21st and then again later so you got 2 Nissan pulls and a dealer pull.

    Now, if the dealer pulled it 2 weeks later, you'd have them nicely ;)
