Has any one ever been allowed by court order to opt out from the CRA's? Even 2 out of the 3 so only one CRA has records? What gives them the legal right to report private information?
The FCRA provides them the right to report private information. To my knowledge the only court orders have been against them to report specific disputed information, not to require them to not create a file for the consumer. Here is your problem, if you delete your file @ 2 of the CRAs, you are PERMANENTLY denying yourself of the opportunity to obtain credit from any company which uses that CRA to evaluate applicants. No reasonable company is going to enter into contract with a CRA to pull reports, just to pull the report for ONE INDIVIDUAL CONSUMER.
That may be true, however I have 12 inquiries in 2 years. 10 to TU 2 to EX 0 to EQ Given the shady way EX does business, I would rather not deal with them at all. These boards of full of FCRA violations by EX. Unless a class action lawsuit is brought against them, they will continue to violate consumer rights.
You may not want to deal with them, but some creditors you may want to do business with may have decided to deal with them. Having no credit file does not generally help get you approved for anything.
boycott experian I disagree. No report on record is better than a incorect report that prevents you from obtaining housing, employment or insurance. If there is no enforcement of the FCRA then a boycott is the answer. There a too many creditors to count, you can always find one that uses transunion.

Thats a good point. It is a tough road for a consumer to take, when they challenge the establishement on their own. It would be be nice to actually have a federal agencey that could investigate them, and investigate individual complaints. Or a consumer rights group that would be wiling to file a class action suit. Instead of chipping away one consumer at a time, they need to be brought under control, and be forced to follow the FCRA
