Original contracts

    When we request a validation of the original signed contract can we request that the original document be provided for insepction?

    I know one company is providing a scanned copy of the contract. They don't acutally have the original.

    1*No as far contracts have never had the occasion.
    2*How do you know this scanned copy is authentic. It could have been forged or other wise altered.

    A personal example. Phone co. hit me with 4 returned check fees.
    The copies they sent me were not made from the original checks but were copies of the forgeries of the original checks.
    There were 4 returned check copies but there were only 3 check numbers on the 4 copies the phone company sent. 2 of the copies had the same check number but the dollar amount was entirely different for each of these 2 copies.
    For reasons just described I would be very skeptical of a scanned copy.

    I know it is a scanned copy because of the file name at the bottom :). Only thing is I don't know if I have the right to requiest to view the original.

    If you give me a little time, and an example of your signature, I can provide you with a scanned copy of a contract that shows you bought the Brooklyn Bridge from me.

    Would you accept is as proof when I asked for payment from you for the bridge?

    I am getting like really confused as to what's going on in this thread.


    I am trying to find out if I have the right to request to view the original contract in my validation request(s). I know that most of the time the answer to validations come through the mail, but in my case I have a company who has forwarded a print out of a scanned copy. So.....can someone please tell me if I have the right to request/demand to view the original contract without going to court? In otherwords in my validation can I request the original be made available for inspection on or before a certain date?

    Now to answer your question....No, I would not accept this as proof; however, I am trying to address the validaton procedures and original contracts. I haven't read anywhere where others have requested to view the original contract when a scanned copy of the original has been mailed to them in response to a validation. Heck, I can do the same thing you have proposed but that doesn't address the legalities of validation and this is what I am desperately trying to get an answer to.

    Ok. The scanned copy isn't acceptable, in my opinion. Ask them to produce the original.

    The problem that you may encounter, if you end up in court, is that you might end up with a judge who decides that the scanned copy is acceptable. Not much you can do about that.

    The only reason(s) I can see for someone refusing to provide the original is .
    1*There is no original.
    2* There never was an original
    3*The copy is a fake or forgery.
    Makes me ask what are they trying to hide or pull?

    Courts operate on the best available evidence. If a copy is all that's available, they'll likely accept it if it's legible. Look at the classaction lawsuits involving tobacco and asbestos companies. Documents that existed only on mirofliche from the 1940's and 50's has been introduced as evidence and accepted by the cout.
    You can ask for an orginal all you like but noone in their right mind will send it to you. Very easy to destroy.
    You also don't need a contract to win in court. Many have lost when all the creditor had was a few credit card charge slips and monthly statements or, copies of checks written to the account.
    At the end of the day and in a worse case situation, validation is whatever a judge says it is.

    Here's a stragedy that is used when a contract isn't available.
