Been a while since I posted, and sorry for this being off topic, but thought if I could get good advice, it would be here. With the help of the board, I repaired my credit through disputes, time, establishing new credit, small claims suits, etc. All this in an effort to obtain financing for a 2002 Toyota Double Cab 4X4. Mission accomplished. Five months ago I bought the truck I've been wanting for years, and saving down payment for for 1 year. Long story short, it was stolen 3 weeks ago with 4k on the speedo, recovered 1 week ago. Been without my new truck almost a month now. They took rear drive shaft, instrument cluster, and other minor parts, but did considerable damage to the dash in the process. Estimate so far at $6500 to repair. MY PROBLEM: Found out today, most parts required to repair it are on "national back order" and I am now told it will be 2 months absolute minimum and up to 3 or 4 months until I get it repaired and returned to me. Anything I can do? I am in California. I can't find much of anything on the net about my rights here. Seems to me it should be totaled out if they can't get it back to me in a reasonable amount of time. Rental car reimburse is only 30 days coverage, so I'm effectively left without transportation in one week, for god only knows how long, all the while having to make $450 a month payments on a car I can't drive, and on a car which has lost value as a result of the theft. California is not a "diminished value" state, that much I do know. Any help appreciated. All that time and work to repair my credit to get this thing, and then this happens. Supershawn? Anybody in auto insurance? Thanks, danrs
Oooooh no help there. I wish I knew of a way to help. This is a wierd situation. Even if they totalled it, you would come up short. The value drops as soon as you drive it off the lot...you would still be owing on this truck (that's what they call the "gap" on new cars) the car is worth less than what you owe. Maybe a family member or friend could help you out while you wait? No other options I know of. I'm an agent. Your company is doing what they're obligated to do - nothing to fight about with them. You have to figure out a way to get through this time. Did they catch whoever stole your truck? Make sure he goes to prison, hehe.
