OT- Can I break lease based on this

    We've been renting at the same place for over six years now and we've always been good tenants. I've complained three times because our neighbor smokes and the smoke comes in through the sound board (? not sure if that's what it's called) ceiling in our downstairs bathroom. There is not a no-smoking clause in our leases so she has a right to smoke, but I think my family also has a right not to have to breathe in that second hand smoke. So far nothing has been done. Do I have any legal rights here, and how do I go about exercising them? I have called three times but did not document the exact dates.

    We are going to be looking at buying a house in the next few weeks (our lease isn't up till next April). Is there a way I can use this to break my lease without having to go through all the hoops of finding a new renter? I'm open to any opinions of this situation.
