    I sure do. First hand knowledge and experience.

    And it's a lot worse when that bad advertising is false and untrue and has no basis in fact whatever. Pure slander and nothing more.

    That's when it really gets bad.

    Suppose that company had a proven track record of paying every claim in full to the last penny to those who were unhappy with either their service or their product yet were still getting publicly slammed?

    It happens all the time and that's when it really gets bad.

    I understand. I swear evry statement I said is true, and I never ask for extra money, upgrade product to them. I went to the BBB hoping to solve it fair & fast so everyone get back to their life. So when they send me the letter with that ridiculous allegation, I had to fight back. I have no money, no background, no help. The salesman said to me once" I know you are a housewife & has nothing better to do but for trouble.." well, that is not true. I gave up my job to be with my kid & my family, not to fight this ridiculous fight. Who are they to judge me, and makes remarks like I am a 2nd class citizen. Every violation I pulled out from Federal & State codes cost me hours of sleep & quality time with my children. I gave them 4 months to solves this, in returnd they gave me a letter threating to sue me just because I exercise my right as consumer? This is United State fo America, not China nor Cuba, I believe "little" people like me is still entitle to justice, dont you agree?

    I did not intend to even suggest that anything you said or did was untrue. I was speaking of my own personal experiences only

    true guys,
    what am I thinking, ha ha..
    well I guess the best way is do it myself...
    Ok, so if I dont heard from them next week, should I send a "intend to sue" letter ? Should I address to the manufature or the dealer?

    Well, what I have seen fairly often in such situations is that the dealer is sued and the manufacturer is sometimes named as a co defendant.

    Dear Ms Zy;
    I am in receipt of your letter dated march 19,2003. First of all, one one has chosen litigation at this point. Evilass Carpet also like to bring this issue to closure without further expense and inconvenience for all concered. Therefore without responding point by point to all of the allegation in you letter, which are of course disputed, let me simply ask you this.-you stated thaat you spoke with our rep & agreed to the cash refund, Are you still willing to accept the cash refund of $ 1300, if so them I beleive this matter can be settled prompty.

    ------this is the same ppl that threat to sue me for defamatory, now does the letter seem "soft" ?
    What they offer will be fair IF the carpet situation dont get worse, BUT if the damage area worsen, that money wont cover 1/2 of my house. I still felt I am entitle for the full refund. what do you think?

    Stick to your guns! Ya see, the manufacturer and dealer have already ADMITTED to the defect when the dealer accepted a refund from the manufacturer. Why should the little guy be shorted?



    Dear Butthead Attorney,

    After your completely false accusations of defamation in an attempt to try and intimidate me, when I exercised my rights as a consumer, I am in no mood to accept a settlement for anything less than the full amount I paid for the carpet.

    If Crooked Carpet company wants the carpet back, they can come get it!

    (OK, maybe something a little more professional).

    thanks jlynn, I couldnt agree more.

    One thing I have to point out....dont use the BBB, it doesnt work!!
    they already close the file, and they dont care if this company violated the law.. Can you believe that!!
    and the comments they wrote is..

    "Bureau File Experience

    Our complaint history for this company shows that the one customer complaint brought to the company's attention was responded to and given proper consideration. ..."

    so the business reliability report is not necessary reliable..
