OK, here is the situation: I loaned some friends of mine two major appliances for their personal use, as I did not need them at that time. The deal was, verbally only, that when I needed them, the friends would return them. So the time came that I needed them back and asked that these items be returned. They refuse to return them, and state that they have them so the law says they in their confines and they do not have to return them. So how do I proceed on this? Had they had to rent them at fair market value the cost averages about $25.00 to $50.00 per month. Replacement cost, to which same models do not exist are close to $1200.00. Send a collection notice? yeah they send validation letter and I have nothing in writing. Need some creative ideas here.
judge judy! you do not NEED a written contract... I would send them a certified letter.. if you know a laywer have him or her do it on their stationary... good luck..
Don't misrepresent attorney representation. That said, most people will respond promptly to a well worded letter from a lawyer. You could file in small claims court. You should first attempt to get them to return the items, as you have apparently done. Make sure you have a paper trail of your attempts, not just your verbal conversations.
Doesn't sound like friends to me. If you were the original purchaser and you have a receipt, it may have the ownership information you need to prove it's yours. Or you can possibly get that from an old CC bill, warranty card, etc. Also, is there someone who helped move the equipment over to their house? Use them as a witness.
Friends,,,,yeah before all of this. Maybe can dig up the receipt, but yes can get the testimony of the people that helped move the equipment over to their house.
