OT RE: my neighbor

    this is off the topic, but I was wondering if anyone here had ever heard of this. I live in an apt. complex, and yesterday when I got home, there was a message on my machine from a bill collector, for my NEIGHBOR. Seems ford can't get in touch w/ her, so they called EVERYONE in our building--to get us all to give her the message. I am horrified. First of all, I don't really know her other than to say hello. I certainly don't know her financial status. I feel so bad for her, because she is so embarrassed. I went over and talked to her today, and she said they called all 7 apts in our building. Can they do that? That seems to violate some sort of rights. I didn't hear the whole message, so I'm not sure if they told us that it was about a bill. I know that would be a violation--for discussing it w/ us. It just seems wrong to discuss it with her neighbors.

    § 805. Communication in connection with debt collection [15 USC 1692c]

    (a) COMMUNICATION WITH THE CONSUMER GENERALLY. Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt --

    (1) at any unusual time or place or a time or place known or which should be known to be inconvenient to the consumer. In the absence of knowledge of circumstances to the contrary, a debt collector shall assume that the convenient time for communicating with a consumer is after 8 o'clock antimeridian and before 9 o'clock postmeridian, local time at the consumer's location;

    (2) if the debt collector knows the consumer is represented by an attorney with respect to such debt and has knowledge of, or can readily ascertain, such attorney's name and address, unless the attorney fails to respond within a reasonable period of time to a communication from the debt collector or unless the attorney consents to direct communication with the consumer; or

    (3) at the consumer's place of employment if the debt collector knows or has reason to know that the consumer's employer prohibits the consumer from receiving such communication.

    (b) COMMUNICATION WITH THIRD PARTIES. Except as provided in section 804, without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a postjudgment judicial remedy, a debt collector may not communicate, in connection with the collection of any debt, with any person other than a consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector.

    You said you did not hear the whole message. Was it on an answering machine, or did someone at your home take it?

    Hi,

    This was done to me by a collection agency pretending to be a lawyer.

    When I returned his call, he stated that he could call anyone as long as he didn't tell them what it was for.

    He even had the nerve to tell me that I could tell the neighbor that I had a lawsuit pending and their lawfirm was my lawyer!!!!!

    Yeah, I can see my neighbors happy that I am getting money :( LOL.

    Things like this are so bad because your neighbors don't need to know your business......

    Since I have found this wonderful board, I now know how to deal with clowns if this happens in the future.

    Which it won't because I found this board :)

    You who good at doing that... Ford Motor Credit. I was late on my payment back in 4/99 and when they couldn't reach me they called my mom. I still hear about today. When I got married I changed my name and address on-line but didn't have the new working phone yet, they called my mom to verify my new name and address and to see if they could get my new number out of her. She of course thought I was late on my payment again. I caught hell, again.

    That's who it was, ford motor credit. I still can't believe they did it. Just because they are such jerks, I wouldn't give them the time of day in the future!!

    they do have the worse cust serv rep, I assume their coll dept is worse..for an unauthorized inq they made on me, I had to threat them lawsuit for them to respond..
