Scout posted a site that had a lawyers take on the FCRA and some related laws and how they effect creditors. here's the link: http://www.credit-and-collections.com/article-col-polk.html One interesting statement: Deceptive Trade Practices Act. According to Section 621(a)(1), any violation of the FCRA is considered to be an unfair or deceptive trade practice in commerce and in violation of Section 5(a) of the Federal Trade Commission Act [15 U.S.C. §45(a)]. I don't have time to look it up, but could this be something we can tack on to our lawsuits or is only related to fines imposed by the FTC or other government agencies?
Deceptive Trade Practices Act. considered to be an unfair or deceptive trade practice Sure fits the description of how CAs & CRAs & OCs operate doesn't it. slppryslp
15 U.S.C. §45(a) Has only to do with CHRYSLER CORPORATION LOAN GUARANTEE and was omitted in 1980. Really burns my butt when a lawyer can't even properly site a code section. LOL
