    Like everything there are two sides to every story.

    But the one thing that sticks out in my mind has led me to my own opinion over 6 months ago.

    DH and I were planning to move to Washington State. In November we made a trip up there to look around. I talked to the above individual via email and we made a tenative plan to meet on a certain day we were going to be somewhat close. I left it in his lap to call my cell or our hotel to let us know the time he was going to be available. We never heard from him again even after we got home. The unfortunate part of this for him was we had a friend with us that day who ended up buying a home locally. I felt like a fool waiting for his call after telling our friend who lives up near him that I felt he was a real honest guy to deal with.

    So I think this establishes a track record early on for not going this distance. All of us live and learn, but for some the learning is a bit more difficult. I am sure that in the future, Will knows to be more upfront and diligent in making sure people know the facts and that he has documented all communications to avoid he said/she said issues. And that if you say you are going to so something, its in your best interest to only promise what you can achieve.

    You know, in the situation my family, my children are in because of the actions of this guy, it is a slap in the face to read Butch and Jenz standing up for him. I have no place to live after the 17th of July. I told Will I had given 2 months notice. We have 2 daughters, what am I supposed to say to them? We were supposed to close on June 10th, and had repeatedly been assured that everything was fine. I got a puppy from the shelter because I was sure we would be in our house by now. I can't have dogs here, what am I supposed to do now? My kids have lost their new house, I suppose its only right to take the puppy away too. I had been packing for the last month. And I would have had my house, if Will had worked on my loan, he just chose not to do it. There were days when I had tried franticly to get a hold of Will, leaving messages that were never returned, e-mails, yet I would sign online to see he had been responding to posts on the Art of Credit Forum. This went on for 2 months. Every time I faxed something to him, he never received it--in spite of the fact I would get confirmation on the fax.

    This whole notion of bringing in 7 million dollars worth of business in 45 days is ludicrous. My husband is in hotel management, and of course there is a big emphasis on bringing revenue to the hotel. But, at the same time, if he went around booking too much business for the hotel to handle, he would have a lot of unsatisfied customers on his hands. Booking 1000 rooms for a night when the hotel only has 250 rooms is a pretty stupid thing to do. You are going to be leaving 3/4 of the people out in the cold. In a way, that is what Will did to us.

    SO, go a head Butch and Jen, tell Will he is a nice guy who made a mistake, just don't ask me to agree. Yes, there are two sides to every story, and Will has an easy out from telling his side, by falling back on his "professional ethics"--I can't comment on this situation publicly, blah, blah, blah..... Well, lucky for him, I wish he had been so ethical when he repeatedly lied to me over and over again. Has Will apologized, or accepted ANY of the responsibility in my case? NOPE! In his mind, I was the bad one for typing 4 letters---BUMP.

    why am i defending will? because i am in pretty much the same industry but as an underwriter. i see LO's promise things and our company tries to deliver. he is not a petty thief - simply someone who made a mistake by thinking they could take on as much as he did.

    how about every time you make a mistake the person you made a mistake against goes online and starts bashing you?

    i have yet to see anyone who is bashing take accountability for their part. did you try another lender/broker? why would you give notice before having anything in writing from the lender? why would you buy a pet before signing the closing papers? i have seen numerous deals fall through at the closing table and people really get screwed...none of you made it that far. did he make some mistakes - yes, and he apologized. does it fix things - no. no one is perfect.

    all of you who feel will "wronged" you have not posted what you have done to get that house. i think it is JenC who is saying in a few weeks she won't have a place to live. have you tried another apartment? another lender? renewing your current lease?

    the minute my lender doesn't return my call within a reasonable timeframe, i find a new lender. promises don't mean jack until you have it in writing.

    I am sure that there are people out there who are better at Will's job than him. There are also people out there who are worse at Will's job than him. Will gets/got bashed because he posts here and other forums. Just as people here try to let others know their experiences with collection agencies, credit card companies and credit bureaus,, we are letting others know OUR experiences with Will.
    Some may have had bad experiences with EQ, while I have personally had good experiences with them. I can read posts about bad experiences and not "throw stones" at those who have had them. Those that have been hurt by Will do need to and should accept SOME responsibility for it - either for being nieve enough or trusting enough to believe in him, or for not knowing what they needed to and should have known before stating the home buying process. HOWEVER, if I take my grandson to the pediatrician, I should be able to trust that he knows what he is doing - afterall, that's what he went to school for and that's what his job is. I should not have to worry about whether or not he knows what he is doing. It's about trust. Some of us placed our trust in the wrong person and it is US who will suffer the consequences. How I wish that my suffering or way of making things better was as simple as a "general apology" on a forum or a standard email apology.

    ok Jenz... what about the family like mine, who when I told will we were going to move out of our apt and in with family while we saved up some $$ was told ok, good idea. I talked to will everyday either via email or phone, until he stopped contacting me. I was out of town the weekend of April 2 and 3 but on the 4th I spoke to will on the phone and he said " played with the numbers and you are approved, no problem." This yes was a week after we moved out of our place and into my sil's. This after will told us that once we found a place we could be in within 2 weeks time. We found a place, we gave will the number of the owner, and gave the owner will's number. neither one communicated with each other, Will said that Jack didn't call him, but yet Jack said that he never heard from will. What did I do, drive 100 miles to the house and called will from the driveway and handed jack the phone, they talked then. We ended up finding another house same price that we were prequalified at and told preapproved, and talked to will from that house. After talking to will we gave the owner an offer, she accepted, I immediatly called will back and told him. He said great, get a contract and we will get you closed, this was now April 19. Contract signed on April 21, closing on May 11. Will said "after you get is signed, fax it to me" I did, went straight to walmart had it faxed within 20 minutes of signing. He said the next day YES he received it.
    Now after this is when I can't get ahold of will anymore. I want to know when the appraisal will be. Go ahead have the inspection done he said. Did that, $300 later we are out the inspection money. We are now staying at a hotel since the day after easter because my sil didn't know her homeowner association only allows over night guests for 2 weeks and we stayed 3. Hotel is costing us $300 week and then we have to pay for our meals since we can't cook now, there goes the money we were saving by moving out of our apt. Well then I see the original post by byte me saying that they were having problems. I pm'd saying please tell me that it is not will that you are having problems with. Story was just too familiar though. Yep, sure is, that was the response. Well... then comes wednesday may 5, I am on the phone with will while on my way home from Miami. I tell him I need to know, what in the heck is going on. THEN he tells me he cant' get the loan done. This after I talk to his boss at national city on Monday and tell him what is going on with the boards, and where to find the posts. By the time I get off the phone of course I am crying, I am in front of the gym where my kids are at baton practice, and I have to go in and face them, telling them we are not getting the house. We were supposed to close less than a week later, the day before my daughters 16th birthday, and we have no home.
    I guess will might have felt guilty, not supposed to say this but he did pay for ONE night of a hotel stay for us, actually his wife did, it was on her credit card. He didn't pay for the 5 weeks in total that we were in a hotel, to a tune of $1500 not counting the expense for the meals cause we as a family of 5 had to eat out everyday cause we had no way to cook, so that is about another $1500 or more.
    Not to mention the heartache that this has caused. And yes will, I know your probably reading this, I did end up in the emergency room with migraines. I have a vicoden prescription just like you do.
    If you had told the truth to begin with, then you would have saved us all a great deal of money.
    Yes I finally did go with another mortgage person and could not get the loan through them either, most of the reason for that is because of the big drop in scores that came from the total of 25 times you had my credit pulled. The other part of it was because now, I have no rental history for the past few months, so they have nothing to use for that.
    Will do yourself and alot of others a favor, get out of the mortgage business, because you have NO business being in it.
    Yes I will be a loan processor starting in August, but at least I know now that constant communication with my customers is what is needed, As well as HONEST communication.

    I do not know how you sleep at night with what you have done to so many families. I know you have a family, and I do not understand how you can face them.

    trust me - i do sympathize...i am not taking sides or saying what he did was right. i would hope that if you did have a good experience with EQ, you would tell people so...we need to share the good along with the bad.

    the problem with trust is that you didn't know will. when you go to the doctor, i'm assuming you've researched them...Will (and Loan Queen and even myself) are simply people you know on the internet. i have said numerous times (as did Will in his post) that you should work with someone you trust when it comes to getting a mortgage - your local bank, a referral from a friend or family member, etc.

    i'm not discounting your poor experiences, that is not a level of service that I myself would tolerate (but I am rather demanding and LB will attest to that!) and I hope each of you (Will included) have learned something along the way.

    that said, lets move on to better times.

    good luck with the credit repair and i know that you will find a lender that will help you get the house of your dreams.

    Will is the one who put himself in this position, he is the one who markets himself through the Internet and these boards. Why would anyone be surprised that he would get negative feedback on these boards as well? I don't consider it bashing, but more of a warning to some poor unsuspecting person who feels he is trustworthy enough to help them. I wish I would have read this thread a few weeks earlier. I would have been enjoying my new house by now if I had.

    As far as me being accountable? I had 3 mortgage approvals on this one, including NCM, but by then too much time had passed and I lost the house. The house was supposed to close on June 10th, and the seller waited until June 22nd and he was losing money. Giving notice? I had to give 60 days notice here, I was not about to pay 2 months rent on an apartment after closing. And how do you know what I did or did not receive from Will? You are making lots of assumptions. I agree I jumped the gun when we brought the puppy home.

    JenZ, if you see lots and lots of deals fall through at the closing table, then you must know a lot of mortgage and real estate professionals who don't do their jobs. And for the record, Will has never apologized to me.

    What do you think I have been doing--scouring the local Sears and Best Buy dumpsters for his and hers appliance boxes? Get real.

    As far as the house, I lost it--plain and simple. The seller got tired of waiting for Will to return numerous phone calls and put the house back on the market, where it stayed for 1 day before getting another offer. And even after Will became aware that an other couple had made an offer on the house, He still would not return phone calls. But that is just the tip of the iceberg, there is much more to this story

    Promises don't mean jack? Do you think that's a good or bad way to do business? I don't know too many professionals who go around making promises they can't keep, and the ones that do don't have a job or a business for very long.

    Sorry JenZ, but you sound like the kind of person who thinks they are doing their customers a favor simply by doing the job they get paid for. Maybe you should look into another line of work, where you don't have to be accountable to anyone. It scares me to think there are mortgage professionals out there that actually think the way you do.

    As I stated before, my hands are tied and unfortunatley I cannot explain the whole situation. I do not mind former clients of mine stating (whether partially or incorrect) their personal situations. I have no idea what more that I can do and I think it is good for them to be able to vent. What I will not tolerate is a comment by Steve which is Libel. If you are in law enforcement I am sure you know what this word is and how you have deffinatley walked into this. If you would like to go forward with an investigation on your own Steven and look into any Illegal or unlawful (notice that I left out unethical and bad business practice) I encourage you to do so. The FTC, State Attorney Generals Office, as well as each states finance department would be a good place to start. They are more then welcome to look into any file on any borrower that they would like. As I stated earlier, if you were a client or are unhappy with something I have done to you personally I encourage you to speak out. If you speak untruths or engage in Libel though, you would be doing yourself more harm than good. Steven you are more then welcome to contact me personally and discuss these matters as I would LOVE to hear what you have to say in person. Be careful what you write though my friend. ;)

"Whether partially or incorrect" You make it sound as if there is nobody here telling the truth, they are intentionally leaving things out of their terrible experience, and you hide behind the whole "unfortunately I cannot explain the whole situation" excuse - yes EXCUSE! I have absolutely NOTHING to hide, omit or lie about in regards to my personal experiences with you. Your condescending attitude combined with your overwhelming need to continue to imply that it is those who have had the terrible experience with you that are not being truthful shows all.
    Had you stopped while you were ahead and not continued attempting to place blame on others, a phone call explaining things would have gone a long way!

    Sounds like a threat to me! Don't worry Steven, he doesn't have the "time" to do anything.

    I originally believed that you really did care about what had happened and that you really did feel badly. I believed that you had taken on a lot of business out of your genuine care for others. I believed that UNTIL you started on with your posts leading others to believe that it was those telling their stories who were not being honest and you began the never ending line about not being able to tell the real deal.
    If I'm not mistaken, in one of our first conversations you told me that you make most of your money off referrals. Could it be that the fact that people are speaking out make you a bit concerned about the referrals - or is it just your nature to continue to be condescending?
    I will speak out and say what I want to say, falling within the guidelines of this board, and you can do whatever you want with it.

    I 100% agree with this post and it should be considered by anyone that had recent past problems with credit. Why do we find ourselves here? Why was there a problem, and what have you done to prevent this again? Will has contined to help people and probably bit of more than he can chew. Why did Will bite off more than he can chew? Because he is a good hearted person that has an agenda just like you do.

    #1 you want a house after a BK or credit problems, Do you blame him for what didn't work? Who is it that had a credit problem that brought you to this board? Did you not realize that you are a credit risk no matter what anyone tells you? Will took the information that is out there to try and help you ASAP with your personal info. I have read Will Tygarts posts and suggestions for over a year now. The guy is pretty honest in his posts and if I ever have a question or would need help I would ask this guy first before anyone else. Tygart told me in all honesty to wait until I was more stable and had better scores after a BK. Tygart was right and I realize that now.

    #2 Can Tygart get you into a house with bad credit or a recent BK? Maybe he can but you as an individual have to realize the downs vs the ups. The negative posts by others VS Tygart I would bet only show one side of the story. I am sure Tygart might be as fault somewhat VS the other side of the story but I would bet the other posters vs Tygart are not telling the whole truth. Why are you in this position with a problem? Did you not fully realize that you have a problem with your credit overall. Do you actually think you should be approved with decent terms? If I didn't read all of the informitve posts by Will I might have tried for a mortgage earlier. If you actually go though Will's posts and realize the pro's vs con's you might be able to make an adult decision based on reality.

    RCW 19.146.0201
    Loan originator, mortgage broker -- Prohibitions -- Requirements.

    It is a violation of this chapter for a loan originator, mortgage broker required to be licensed under this chapter, or mortgage broker otherwise exempted from this chapter under RCW 19.146.020(1) (d) or (f) in connection with a residential mortgage loan to:

    (1) Directly or indirectly employ any scheme, device, or artifice to defraud or mislead borrowers or lenders or to defraud any person;

    (2) Engage in any unfair or deceptive practice toward any person;

    (3) Obtain property by fraud or misrepresentation;

    (4) Solicit or enter into a contract with a borrower that provides in substance that the mortgage broker may earn a fee or commission through the mortgage broker's "best efforts" to obtain a loan even though no loan is actually obtained for the borrower;

    (5) Solicit, advertise, or enter into a contract for specific interest rates, points, or other financing terms unless the terms are actually available at the time of soliciting, advertising, or contracting from a person exempt from licensing under RCW 19.146.020(1) (f) or (g) or a lender with whom the mortgage broker maintains a written correspondent or loan brokerage agreement under RCW 19.146.040;

    (6) Fail to make disclosures to loan applicants and noninstitutional investors as required by RCW 19.146.030 and any other applicable state or federal law;

    (7) Make, in any manner, any false or deceptive statement or representation with regard to the rates, points, or other financing terms or conditions for a residential mortgage loan or engage in bait and switch advertising;

    (8) Negligently make any false statement or knowingly and willfully make any omission of material fact in connection with any reports filed by a mortgage broker or in connection with any investigation conducted by the department;

    (9) Make any payment, directly or indirectly, to any appraiser of a property, for the purposes of influencing the independent judgment of the appraiser with respect to the value of the property;

    (10) Advertise any rate of interest without conspicuously disclosing the annual percentage rate implied by such rate of interest or otherwise fail to comply with any requirement of the truth-in-lending act, 15 U.S.C. Sec. 1601 and Regulation Z, 12 C.F.R. Sec. 226, the real estate settlement procedures act, 12 U.S.C. Sec. 2601 and Regulation X, 24 C.F.R. Sec. 3500, or the equal credit opportunity act, 15 U.S.C. Sec. 1691 and Regulation B, Sec. 202.9, 202.11, and 202.12, as now or hereafter amended, in any advertising of residential mortgage loans or any other mortgage brokerage activity;

    (11) Fail to pay third-party providers no later than thirty days after the recording of the loan closing documents or ninety days after completion of the third-party service, whichever comes first, unless otherwise agreed or unless the third-party service provider has been notified in writing that a bona fide dispute exists regarding the performance or quality of the third-party service;

    (12) Collect, charge, attempt to collect or charge or use or propose any agreement purporting to collect or charge any fee prohibited by RCW 19.146.030 or 19.146.070;

    (13)(a) Except when complying with (b) and (c) of this subsection, to act as a mortgage broker in any transaction (i) in which the mortgage broker acts or has acted as a real estate broker or salesperson or (ii) in which another person doing business under the same licensed real estate broker acts or has acted as a real estate broker or salesperson;

    (b) Prior to providing mortgage broker services to the borrower, the mortgage broker, in addition to other disclosures required by this chapter and other laws, shall provide to the borrower the following written disclosure:

    THIS IS TO GIVE YOU NOTICE THAT I OR ONE OF MY ASSOCIATES HAVE/HAS ACTED AS A REAL ESTATE BROKER OR SALESPERSON REPRESENTING THE BUYER/SELLER IN THE SALE OF THIS PROPERTY TO YOU. I AM ALSO A LICENSED MORTGAGE BROKER, AND WOULD LIKE TO PROVIDE MORTGAGE BROKERAGE SERVICES TO YOU IN CONNECTION WITH YOUR LOAN TO PURCHASE THE PROPERTY.

    YOU ARE NOT REQUIRED TO USE ME AS A MORTGAGE BROKER IN CONNECTION WITH THIS TRANSACTION. YOU ARE FREE TO COMPARISON SHOP WITH OTHER MORTGAGE BROKERS AND LENDERS, AND TO SELECT ANY MORTGAGE BROKER OR LENDER OF YOUR CHOOSING; and

    (c) A real estate broker or salesperson licensed under chapter 18.85 RCW who also acts as a mortgage broker shall carry on such mortgage brokerage business activities and shall maintain such person's mortgage brokerage business records separate and apart from the real estate brokerage activities conducted pursuant to chapter 18.85 RCW. Such activities shall be deemed separate and apart even if they are conducted at an office location with a common entrance and mailing address, so long as each business is clearly identified by a sign visible to the public, each business is physically separated within the office facility, and no deception of the public as to the separate identities of the brokerage business firms results. This subsection (13)(c) shall not require a real estate broker or salesperson licensed under chapter 18.85 RCW who also acts as a mortgage broker to maintain a physical separation within the office facility for the conduct of its real estate and mortgage brokerage activities where the director determines that maintaining such physical separation would constitute an undue financial hardship upon the mortgage broker and is unnecessary for the protection of the public; or

    (14) Fail to comply with any provision of RCW 19.146.030 through 19.146.080 or any rule adopted under those sections.

    I dont know where you come off. Libelous, are you kidding me. People dont live in hotels because of me (well unless i arrest em and they go to the county hotel, which is free).. And im not going to go calling anyone, or investigating anyone. thats crazy talk. And everyone knows it. Im just saying that what im observing is........... well in my opinion not on the up and up.. were talking about peoples welfare here.. a place for a family of 5 to live. Your not the one on the street so u dont care do you..Your not the one who's daughter has to come from baton practice back to a hotel do you. Your not the one shelling out money on housing inspections, and 25 credit pulls on your report. All your doing is making money. And u cannot tell me u took on all that business for love of trying to help people. I think, you wanted every last nickel you could squeeze out of people. Bottom Line.. thats not libel, its opinion which im enititled to.

    Discussions regarding any credit vendor, including threads about those who market mortgages, are obviously germane to this board's topic and purpose. Outright insults, however, are not, and such postings violate the Creditnet Terms of Service.

    This thread began as a hard-hitting critique of a mortgage broker's performance. Somehow it devolved into a complicated political mess involving two other consumer credit discussion boards. Risking redundancy, I will restate Creditnet's position regarding those other boards: Both Creditboards.com and ArtofCredit.com offer vibrant and informed discussions regarding consumer credit, consumer advocacy, and related consumer protection statutes. Creditnet members would be well served to visit and enjoin either of these other discussion boards, as both communities share the pro-consumer educational mission advocated here. Such common purpose binds our communities together as one, and indeed thousands of consumers are happy members of all three boards and of others as well.

    I am removing several messages which violate our stated Terms of Service provisions. Again, critiques by actual consumers are encouraged, whether pro or con; personal attacks are not.
