Over 7 Years But Keeps Updating

    I have a debt that was charged off 8 years ago but the "date of last activity" is only 2 years ago. How do I go about having this deleted? Is it better to just say to both the CA and theCRA it's not mine or report to them it beyond the SOL?

    Someone on another group recommended a "not mine" validation request to the CA and a "beyond SOL" to the CRA's.

    For the CA send them the validation letter.
    For the CRA dispute as obsolete - - please remove.

    Every time a new CA buys the paper they change the date.

    I would personally send them a copy of WhyChat's time-barred C&D letter.

    Then dispute the account to the CRAs as Incorrect DOLA, *AND* Obsolete, when you know that they have received it.

    If they verify, they have communicated to you in one of the forms that is not specifically allowed under section 805, Heinz v. Jenkins specifically defines communications as anything that conveys "information regarding a debt directly or indirectly to any person through any medium." The key portion is THROUGH ANY MEDIUM, Section 805 allows them to communicate with CRA's but they are still a medium to get you the message that they claim that you owe them money. But the quote I got from it is from an FTC Opinion Letter. :)

    I am looking for a complete copy of this ruling... :)

    Just wanted to make sure it wasn't a payment.
    What ever you do don't make a payment on it!
