Pager Bill Gone to Collections

    Hello.
    I'm still a little new at this game and in search of help.

    Years ago, I had a pager. I closed the account, but continued to get bills. When I told them that refused to pay, they sent me to collections. I ignored the collections notices (stupid, yeah I know ), but eventually I stopped hearing from the CA. I haven't received anything from either the CA or OC in at least two years (no letters, no phone calls).

    I recently pulled my credit report and, sure enough, the collection was on there. The report indicated "Date Opened: 02/01/2002" and "Date Reported: 07/01/2002."

    I plan on sending a validation letter to the original creditor (pager company) and, then upon receipt of the return receipt card, dispute the collections with each credit bureau.

    Is this definitely the correct way to go?

    I don't mean to sound weak here, but I'm a little tentative about waking a sleeping giant.

    I may have some other questions, but I'll wait for you all to weight in on this.

    If I'm not mistaken you need to send the validation letter to the CA.

    Experts, feel free to correct me if I'm wrong.

    Who is reporting? The OC or CA?

    I have been reported by the CA (National Recovery Agency). The OC is TSR Wireless.
    Like I said, I haven't heard from these people in couple of years. Though, my CR says last reported "06/02."
    How do you all recommend going about the validaton adn dispute? My inclination is to assert that the account was closed. However, I have no documentation to support it, as it's been years.
    In advice is very much appreciated.

    First of all, you need to send the validation letter to the CA not the OC.

    Secondly, the CA has illegally reaged the account. This is the first violation they have made. Keep that credit report for documentation. This debt may turn out to be valid, so you'll need ammunition.

    Send out that validation letter and see what the CA provides.

    In the validation letter, should I assert that the account was closed or simply request validation and keep my fingers crossed for 30 days?

    when did the account charge-off? What was the outstanding balance as you remember it and what is listed on your credit report.

    It's important that if you do wake a sleeping giant, you have the money to pay them. Because if it's within the statue of limitations, they could assert every recourse available to them, including lawsuit. It's happened to some people before, so be careful.

    Geez, I had the same exact thing happen. After I spent a year cleaning my credit up and getting 770+ plus score on EX, I had a $9.99 pager go to collections. I'm fighting with them now over $29.

    Here's what you need to do. Don't argue with the idiots about why you don't think you owe the money. They don't care and won't do anything to help you anyway. The only way that you will get them to delete the collection is to get their a$$ on a hot burner.

    1) Send a validation letter to them crrr. Again, don't give them any details, just claim you dispute the debt. Ask for everything (original contracts, applications, etc) including the name, address, and phone number of their agent of service in your state. Let them know that they have 30 days to delete or validate.
    2) As soon as you get the green card back, go online and order a copy of your credit report. If the account is not listed as "in dispute" you have them on a FDCPA violation.
    3) Send a letter to the CRA(s) disputing the debt as not yours. If the CA verifies the debt to the CRA without marking it in dispute and before they validate to you, then you have them on another FDCPA violation.
    4) Assuming they do not validate after 30 days, send an estoppel, demand to delete letter (15 days). If they do not delete, you have them on yet another FDCPA violation.
    5) Lastly, send copies of everything crrr to the CRAs along with the following letter: http://www.creditboards.com/phpBB2/viewtopic.php?t=20
    6) If you still don't get your deletion, you will have due cause to go after both the CRA and the CA. Given a choice, I would take the CRA to court because there is no way that they will be able to bring in any documentation validating the original debt. Also, whereas the CA can counter sue you for the debt, the CRA can make no such counter claim. Also, if by some miracle the CA does legally validate the debt, you can still bluff because the CRA will have no way to document this fact.

    Validation is demanding they prove the debt is yours.
    1*If you tell them the account was closed haven't you just admitted the debt is yours?
    If you're going to confess to the crime why demand that they prove you're guilty?
    2*Just send the validation letter CRRR found in the sample letters section.
    Don't doctor it up and don't sign it.

    keep my fingers crossed for 30 days? CROSSED for what?

    Why should I not sign the letter? I've seen some comentary on this in the past, but didn't quite see the point.

    Because they can use your signature to forge it onto other documents making you liable to the document.

    Now I feel really silly. I couldn't for the life of me figure out who "Pager Bill" was, why he would go to a collection agency or why I would care.

    I guess it's been a really long day.
