Bankruptcy Tradelines Still Showing (DIDN'T MEAN TO PUT PAID CHARGE OFF IN THE SUBJECT TITLE - SORRY) dang, you people here have been so helpful here is my next problem my husband filed bk in 93 - discharged in feb '94 on our eq report, there is a citgo/citibank tradeline that says "account included in bankruptcy" date opened 10/86 date of last activity 08/95 date reported 10/01 - this one says "credit card" can i do something to get this removed? if it was included in the bk why is it a separate tradeline? also what is even more interesting: right above that tradeline is another one for citgo petrolium with the same account number as the one included in bk with the same opened date, different date of last activity 6/97, different date reported 08/97 but also says "account included in bankruptcy" this one says "charge" what to do??? is a validation letter appropriate in this??? jimrie

Re: Bankruptcy Tradelines Still Showing From what you have said, this is what I see: BK discharged 02/94 "citgo petroleum with the same account number as the one included in BK with the same opened date, different date of last activity 6/97, different date reported 08/97 but also says "account included in bankruptcy" this one says "charge"" This account should fall of this credit report in (05/04). If you can get the CRA to agree that the Date of Last Activity should be 02/94, this item should go away now. You could make the same argument for the other item. "citgo/citibank tradeline that says "account included in bankruptcy" date opened 10/86 date of last activity 08/95 date reported 10/01 - this one says "credit card" " This account should fall of this credit report in 07/02. Since its going to go away in two months its probably not worth fighting over. Generally negative items drop off one month early. I assumed that here. In general the close date for a BK item should be either the date the BK was filed or the discharge date. For a chapter 7 BK, these dates will be 3 or 4 months apart. You are looking at a Equifax credit report, the last four digits of each account number are replaced with an asterisk. All regular credit card numbers have 16 digits. Chances are these are different account numbers. One of two thing may have happened. One, you may have had two accounts originally. Two, you may have lost your mail when the credit card sent out a credit card with new expiration dates. Then you may have asked for a replacement card. The credit card company then sent out another card, but this card will have a slightly different account number. Normally this is no big deal. The original card is listed as "lost or stolen". The problem here is that in a CH 7 BK the old account gets listed along with the others and hurts your credit score. I would try to get Equifax to change the dates on both items. The date of last activity should be 02/94 in which case both items should already be gone. BK items last 7 years. The BK entry itself will last 10 years. How are the BK dates reporting on the other two bureaus credit reports? Good luck.

Re: Bankruptcy Tradelines Still Showing With an issue like this I would call them up. They already have the info (the BK dismissal date). What you need is a person with just a tad of analytic skill who can see the dates are incorrect. If that doesn't work, then I would mail them a dispute letter.

Re: Bankruptcy Tradelines Still Showing The regular dispute letter will be fine. You would want to include the information about the dates. The problem here is that if a clerk at the credit bureau just has the information verified by the credit card company, the two computers will talk and very likely the account will be verified. This is why I would just call them at 877-463-5721. If you get a person who seems unlikely to make a change you could call back. The thing here is that they should assume the date on the BK is correct. If they make that assumption then the dates of last activity on these two account have to match. Once this change is made, both accounts should fall of the credit report because they are over 7 years. You could include a copy of the first page of you bankruptcy petition in your letter and send a copy CC to the FTC if you have to write a second letter. ------------------------------------------------------------------------------------------------------------- This is a letter to dispute a debt with a credit bureau.
