I'm in a dispute with a paid Charge Off from an OC. I disputed the account with them via nutcase letter #1. I received my green RRR card in the mail today so I decided to check my report to see if there were any changes. Lo and behold the OC updated my Experian payment history as a CO for march 2004. It was previously listed as ND (no data) This account was paid off over 2 years ago. Shouldn't the account have been listed as "disputed by customer" on my CR's since I'm disputing it? Isn't it illegal for them to report any information the CRA's while an account is in dispute? Any help would be great. Thanks
if in dispute you have no obligation to that debt other then accrued intrest and any portion of the debt not in dispute. Also there should be no adverse action against you from CRA Or Creditor until such a time that ivestigation is complete. info at www.jagcnet.army.mil/legal
this totally misses the point. i believe that verbiage applies to open cc accounts. not paid chargeoffs. jpelosi, was the nutcase letter the first thing you sent the creditor? i really think you should start out nice and dumb with paid chargeoffs, and then resort to nutcase letters later. but, since you didnt, you may want to go ahead and send them a letter explaining how they re-aged the account, which is a violation of your rights as a consumer, and send a copy of the tradeline from your CR--a 'before' and 'after' if possible--to prove the date was changed. (or, you could go an entirely different route and not send your reports, in hopes that they pull your credit reports, which is another violation.) explain that your credit score went down because of what they did. You may want to put all that into what's known as 'son of nutcase'. (do a search.) good luck.
