I had a paid collection for Bellsouth by an outside collection agency removed. They sent me their delete form in the mail and I called Equifax and they are in the process of deleting it. A small victory I wanted to share.!!!!!!!!
It was Franklin Collection Agency in Tupelo, Ms. this is the letter I sent: Franklin Collection Services (800)262-7590 2978 W. Jackson St.. Tupelo, Ms 38803 June 11, 2002 Re: Account # XXXXXX To Whom It May Concern: I received a copy of my Equifax credit report which states that I had an account with your agency. Now, because Franklin Collection Services is reporting me in error to Equifax, I have taken the steps to protect myself from your mistake. I went online to do some research and according to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b), I am disputing your claim and validation is requested. In the mean time I want your agency to notify Equifax that I am formally disputing this. This is NOT a request for "verification" or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. I respectfully request that your offices provide me some documentation that I had some type of legal obligation to you. Your agency is reporting me incorrectly to the credit bureau and I want that mess deleted immediately. I will not hesitate in bringing legal action against because this is ludicrous. You guys are in: · Violation of the Fair Credit Reporting Act · Violation of the Fair Debt Collection Practices Act and destroying my character in the process. I learned also that Franklin Collection Agency has to respond back in reasonable time. I have consulted with an attorney with Pre-paid Legal and I do not wish to take this any further but I will if Franklin doesn't delete the mistake immediately . Once all references to this account has been deleted and completely removed from my credit file, please forward me a copy of such deletion request to me immediately.
