paid in full letter

    Just wondering if a collection agency has to send you a paid in full letter after receiving all payments. I have been dealing with allied interstate (spoke with 8 different people since account was paid off) which was in may. They keep telling me letter will be sent, and I still havent received it. What should I do?

    They don't have to send *ANYTHING* stating that any payments were received, *NOR* that the account has been paid off.

    Look at the FDCPA itself, the FDCPA tells you exactly what they are required to do under Federal Law, and that simply is...

    To within 5 days of the initial communication provide you a notice that you have the right to demand validation of the debt (unless that is made orally; in the case where there first communication is oral.)

    And to provide "This communication is from a debt collector." on all subsequent communications.

    That's basically *ALL* they are required to provide you under Federal Law.

    The rest of the FDCPA, pretty much tells you what they *CAN NOT* do. A partial list of those is to use any deceptive business practices, make false and misleading representations, continue collecting if you've properly demanded validation, communicate you via any method which you find inconvenient, communicate you via any method if you've told them to leave you alone.

    Showing that it is paid in full, doesn't help you in the least bit, you want it DELETED; end of story.

    A paid collection is still a collection.

    If you have proof of the payment (copy of the money order, etc), if anyone like a mortgage company wants to see that it has been paid, you can provide that to them.

    You do not want the account to be showing at all, either paid or unpaid, because either way it is just as bad of an entry. You want it exterminated. In fact, the paid entry could be worse; since it's payment status would only be MONTHS old, instead of however old the alleged original account was.

    it was never put on my credit report (i've been checking), but I don't want them to put it on or sell the account to someone else. So I shouldn't worry about a Paid in Full letter?

    All you have to do is nail their Hyde to the wall if they try any funny business.
