I have a paid judgement. Our state, (NJ) keeps records on computer, so it can't be removed by disputing. Can anyone explain how "Motion to Vacate" works? How much do you think something like this would cost? Also, could the person who got the judgement against me, agree to pull it. Would I have to go to court?
Have you tried disputing it yet? From what I have read on this board, satisfied judgements are quite easy to dispute off. I have a judgement on my credit report, and I'm 1 for 2...still waiting on results for #3. In my state, they also keep records on computer...in fact, they're accessible by simply logging onto the circuit court website. However, this has not stopped them from being removed. Others on the board have had similar experiences. It's my understanding that judgements are reported manually to the credit bureaus--the courts do not report it themselves. Rather, each CRA employs a person that manually researches court records and reports their findings to the CRA. This is why they dispute off so easy. As far as vacating a judgement, I don't know much about that...sorry. Perhaps someone else online can give you some advice on that....
Thanks to the advice of someone on this board, I just had a paid judgement removed from equifax. First, I had my previous address removed from my EQ report - (you can do this online). Then I disputed the judgment as not mine. I just got confirmation from EQ that they have removed it! I'm now moving on to TU.... So, if you have a different address now than you did when the judgement was won against you, try this method. As far as vacating....from what I've read on these boards, it varies significantly by state. If you were served correctly, it seems the only way to do it is to get the other party to sign off on it as well. Check your state court system website and see what they have to say on the matter.
