You asked them to vacate the motion and to give you $500 in damages. Am I reading this correctly? What was the $500 for? I believe that the rules of civil procedure in your state will apply to the SOL for vacation of judgments and supercede the federal law. You may want to talk to someone at your local legal aid society about SOLs in your state or pour through a copy of your State Rules of Civil procedure. Maybe a good old fashioned sob story to the CA/Creditor will work on them signing a joint motion to vacate. Otherwise not alot of leverage here. Did you try a serious round of disputes? Circuit courts are notorious for not responding to multiple request for verification.
I'm not following you on this one, are you saying a judgment cannot be vacated after one year in Fl.?
