Paid off debt re-sold

    I had an outstanding debt from an old CC on my CR so about 9 months or so ago I had contacted the Collection Agency and paid the debt. They in turn mailed me a statement that indicated the debt was paid off in full. However, I just received an offer in the mail from a different Collection Agency stating that they were disappointed I hadn't paid the debt and that they would agree to consider it paid if I paid them half of what was originally owed.

    Didn't some law just get violated in this process? What type of recourse do I have with something like this?

    "I will accept $500.00 as PAYMENT IN FULL so both of us won't have to go to SMALL CLAIMS COURT and you will have to pay $1,000.00 plus costs."

    "If you ignore this...you will have to explain in court why you are collecting on a PAID IN FULL ACCOUNT"

    "The $500.00 offer expires 10 calender days from receipt of this CERTIFIED MAIL."

    Tell us exactly what the letter said.

    Here is the verbiage of the letter:

    "We had assumed that you would handle your obligation to <company>, that apparently is not the case.

    We have been authorized to offer you an opportunity to settle your account if you pay only 50% of the outstanding balance.

    In order to take advantage of this generous offer you must return the notice with a check or money order for the settle amount of $xx.xx.

    Call us for other arrangements."

    When you settled with the first CA, did they own the debt, or were they acting for an OC who owned the debt? Did the old CA sell the debt to the new CA, did the OC sell it to the new CA, or did the OC assign it to the new CA?

    Cross Country did that to my co-worker a few weeks ago. I think she got it straightened out. She's out for the holiday, but I'll ask her what she did when she gets back. I'm pretty sure she sent the cancelled checks from paying off the previous agency and they accepted that as proof.

    It's not up to Juice to prove he paid it.
    It's up to the CA to comply with the law.
    The letter itself is a violation of Juices RIGHTS:!

    In addition, if there are any inquiries after the account was paid off, they are without PP.

    Was the mini-mirandas anywhere in the letter (front or back)?

    Yes, they included their little I'm a debt collector spiel.

    Well how nice of them.

    sheesh. I most certainly would NOT send some stupid CA (who obviously doesnt know their butts from a hole in the ground) a copy of my canceled check!!

    but I'm sure Jenn's friend had no idea (and neither did I several months ago) how unscrupulous some CAs can be when they get such precious info as your checking account number in their grimy little hands.

    Juice, if this isnt on your CRA reports yet, send the CA a letter stating that the debt has already been paid to XX collection agency. They can figure it out from there. IF they keep pestering you, send validation. heck, i'd probably send validation either way.
