questions: i just paid my tax lien (georgia) off in full and would like to know if i should fax the letter to the cra's? or should i just send it? or both? also, how do they report it and is there a chance of me getting it off all together (before the 7 years)? thanks very much duke
Your chances of getting it off will probably lessen if you fax that letter to the CRA's, you will be admitting it is yours. A paid tax lien is not much better than an unpaid. I have heard of success with disputing as "not mine". I have even **heard** of people having CRA's remove old addresses from their profile before they dispute as not mine, making it more difficult to verify the account is yours.
Hi Duke Congrats on paying off your lien! They impact your fico pretty hard depending some on how old theyare. (see my recent post) I agree with Cinderella on her reply. I am no expert on tax liens, but I have done a lot of research on them and can tell you a few things I have learned They are one of the hardest items to delete as all the cra does to cofirm is call the recording office or check on-line. Federal law says a unpaid tax lien can be reported forever if not paid , but state law will supercede that. Here in CA a paid tax lien is reported 7 years from the date it is paid. not the date it was filed. and an unpaid lien will fall off in 10 years from the date it was recorded. Here is an important point to remember-- a paid tax lien is just as bad on your fico as an unpaid one. It does not seem fair. The good thing about a paid lien is that it makes prospective mortgage companys happy. good luck pb
thanks for the replies. i talked to the lady at the georgia dept of revenue and she said she would let the other lady in charge know that it was paid in full and to cancel the lien. is this the same as "taking it off the books"?
Hi Duke If it is on your credit report as a public record then I would ask for a copy of the release of lien, then if you want to file the release you can, but remember if you file a release of lien with the public recorder it will be on your report for seven years from the payment date. In any event make sure you get some kind of paper work for your files saying the lien has been satisfied. You never know when you may have to prove it over again. By the way, I was approved for a new mortgage today even with some paid tax liens on my reports !. Good luck pb
Duke, Did you ever have any success getting your lien removed? If so, how did you do it. I have one on experian that I just paid also.
no it's still there. bureaus re-iterated the seven years from date paid. i just keep my release with me and make sure people know its paid if anyone else has gotten there's released, please let us know...
Dang..I just redisputed with Experian. I know that the address associated with it was removed but it still came back verified yesterday so I disputed it again today via online with Exp. So we will see.
I have had some luck with getting some liens removed. I had quite a few state and IRS liens and they were all released in my BK. I repeatedly challenged as not mine and managed to get one deleted from EXP, one from EQ and four from TU. I have found that EXP online will not let you repeatedly dispute, but EQ and TU online will not limit the number of disputes. I made the mistake of disputing ALL 7 at once. After I looked around here, I decided to dispute one at a time. That worked better for deletions. The ones that have stuck I've updated as released. I know the FICO will be lower, but it's SO much easier to explain to anyone pulling my CR that ALL liens they see have been released.
An FYI.... In CO not only do you pay your taxes, but you have to REQUEST your release. This bit me. I paid my CO taxes in 1995. When I joined this site and got copies of my bureau, I found that it was still listed as unpaid! To make a long story short... The state of CO gave me a release effective 2002. ALL THREE bureaus refused to delete!!! They all base their "date of payment" as the "date of release"! Not that big a deal when separated by days or weeks, but HUGE when separated by 7 YEARS! It took months of threats of lawsuits and providing proof of the LAW (deletion = 7 years from date of payment) before I got all 3 to delete!!!
SCmomof5 Very good point! In CA they send you the release after paying, then you have to send back like four dollars on each lien to have the release recorded. psbates
I had eighteen paid tax liens deleted by saying they aren't mine. With one CRA it took four time, but eventually got them deleted.
