Parking ticket questions

    Hello All,

    I am in the process of disputing what I think are parking tickets. I read some old posts that say parking tickets are fines and as such not quite bound by FCRA.

    My specific questions about parking tickets now with a collection agency are:

    1) Is there a 7 year +/- 180 day reporting period?

    2) Is the statute of limitations a valid concept for parking tickets? (these appear to be from 11/97). And if so which SOL rules - the one for open-ended debt? And what does it mean if the SOL applies and has expired?

    3) Can I demand the collection agency validate the debt? and use the 30day/60day/estoppel method to force CRA to remove?

    4) Are there any laws regarding how much in fees and interest and other charges can be added by the collection agency? Somehow these $650 (as of 3/2000) in old parking fines are growing to $930 in 2/2002. Who if anybody regulates such things in California - the feds? the state? their own decency?

    the problem with these tickets is that the dmv can report them as a lien. be careful.

    In the state of COLORADO, your fines are "TACKED ON" to your driver's license renewal fee...SO I WAS TOLD...

    Any fine imposed by a government agency is not covered under the FDCPA, but if they are reported on your credit the FCRA applies. Dispute them with the agency that is collecting on them, they do not have to validate but if they don't list the tickets as disputed by consumer on your CR they have violated the FCRA.

    The SOL for these would be the same as moving violations or other traffic infractions in your state.
    The seven year reporting period does apply for fines.

    The only way I have gotten mine off was by harassing the parking enforcement agency who wrote them and the city.
