payment history - chargeoff

    Hello
    Hoping to get a removal, I disputed a chargeoff with Equifax based on that they didnt have the correct dates listed in the payment history. I asked them to provide accurate reporting or delete the entry. Well,they deleted the payment history but kept the tradeline listed as charged off. In looking over the FCRA it seems they are able to do this and I am out of luck. Am I correct?

    They had the previous payment history for this account listed. Such as..30 days 1 time late; 2 times 60 days late...etc. When I checked the online version of this entry, they were listing one 60 date as "unknown date" and two 90 day listings as "unknown date" So that was my dispute...how could they know if I was late if the date was "unknown"
    Now they have the account listed as Charged off. With no prior payment history listed. Their responce to the dispute was.."The prior paying history has been deleted from this account.Additional information has been provided from the original source regarding this item"

    Should the prior payment history be listed on a charged off account?

    They are full of it

    They are sooo full of it. They tell some that they HAVE to report EVERYTHING. Others, they actually follow the FCRA, as in your case, in reference to this section of the FCRA:

    § 611. Procedure in case of disputed accuracy [15 U.S.C. § 1681i]
    (5) Treatment of inaccurate or unverifiable information.
    (A) In general. If, after any reinvestigation under paragraph (1) of any information disputed by a consumer, an item of the information is found to be inaccurate or incomplete or cannot be verified, the consumer reporting agency shall promptly delete that item of information from the consumer's file or modify that item of information, as appropriate, based on the results of the reinvestigation.

    Well, now the account surely looks out of wack. How can it be charged off if there are no late payments? ;)

    good point. u have them over a barrel. it has to be 180 late to go into collections.

    So, for example, on my Exp report, it is showing the following

    Discover- Chargeoff 9-98
    Filed Chap 7 BK 9/8/98 to 9/8/98

    Well, this was part of a BK7 but my discharge was 4/96!

    I disputed last summer and it came back verified
    I think I disputed as not mine though.

    Any thoughts?

    yea that's tricky. I am at a loss here. I am not used of BKs maybe someone else can jump in

    Creditman,

    An institution does not have to wait 180 days before they charge an account to p/l. 180 days is when they must charge it off. Some banks chargeoff at 150 days.

    Either way, it *appears* they charged off a good account.

    I agree. I think you should dispute it again. The next rep who looks at it should delete it, without a payment history the rest is crap.

    I had a chargeoff a few years ago at 60 days, so go figure.

    I think that I have a similiar situation. I disputed w/EQ a Belk and Mervyns account back in 2/02. Then in 5/02 I re-disputed the same two accounts and also a Rich's account. Please note that all 3 were charged off accounts. However, with both Belk and Mervyns there is no previous payment history or previous status listed on my report. A good point was made, how can an account be charged off if there is no deliquent history showing? The Rich's account verified that past history was valid/updated. I compared my 3/02 report w/ my 6/02 report and the only difference I see is that instead of showing 6 times past 90 dys it says 5 times. Weird huh??

    Any suggestions? I was truely hoping that neither would verify and would delete since the account has been paid 2+ years.
