Well now I think I've seen everything. My local EQ affiliate sent me the actual verification form that they received from the Original creditor. I had gotten this pd chgoff off of EX and TU, but it was stubbornly remaining on EQ. I disputed it about 70 days ago with EQ and didn't receive anything after 40 days. I sent them a nasty letter informing them of their violations and to remove it immediately. They sent back the form signed by the creditor telling them that everything should remain. I already tried a modified validation on the creditor months ago. That got me a fraud package and not much else. I'm considering the litigous nutcase letter to the creditor, but I'm sure they are on to me by now. Since it was my fifth dispute of the same item and my local affiliate actually does contact them. I was hoping they'd screw up somewhere along the line (like re-aging), but they didn't. Any ideas would be much appreciated
I'm about in the same boat. Mine also came off TU and EX and I thought it was coming off EQ. But it didn't. I've disputed and I've tried nutcase letter. I recently sent a PFB to the original creditor who never reported. I begged for mercy and stated that the CA said it would only remove if original creditor said so. I explained how the bill got overlooked and was paid immediately when I was notified. I explained that the tradeline was devasting my life. I'm waiting to see if this works.
Good luck, I hope it works I think its too late to throw myself on their mercy. I've badgered them way to many times for that. I'll probably throw them version 2.0 of the nutcase letter and hope they screw up (or remove). I now have a different address to send to. The one from EQ's verification form. It's funny that it's not the same address they give me for the creditor on my online credit report.
Pat, Did the signed form have a date on it? if so was it within 30 days of the day you disputed. Just wondering since they didn't notify you within 30 days if maybe they didn't verify within 30 days. Candi
It wasn't within 30 days. In fact they didn't even respond to the December dispute, although I saw it was verified when I pulled my CR. So at about 40 days with no response, I sent them a letter stating that they violated the FCRA, so delete it. This time they took it to be a dispute and verified within the 30 days. I know I have them on that violation, but since the creditor did in fact verify in writing, I don't think I have much of a case at this point.
Pat, If it ws me and I really wanted it gone, I would spend the $50 and file a small claims. When you serve them offer to settle for deletion. If they settle fine, if not go to court and collect for the violation. I bet they would settle though. I realize this would be a pain in the neck. I guess you should consider how much it's affecting yor score and how long it will still be on the report, then decide if it's worth it. good luck, Candi
Candi, You have a great point, Thanks I almost forgot this is the same tactic I used on a Verizon pd chgoff. Sometimes I can see how to help others, but not myself. Verizon violated the FCRA on at least 3 counts. I was prepared to sue them, even though all I could win was money, not deletion. They settled for deletion the night before I was going to file. So I guess it's really the same thing. Only with the EQ affiliate this time. I wish there was more than one violation EQ is such a pain in the a$$ for me. My settlement contact at Verizon has twice sent them a UDF to delete and they still haven't.
