Help! I paid off an outstanding judgment in full to the marshall representing the collection agency. They agreed to cease and desist an income garnishment execution pending payment, which they never informed my employer of. Now the judgment is paid in full and my employer is still deducting $400 per paycheck for the garnishment. How do I reverse this to get my $$ back- I owe the marshall/credit agency nothing and have cleared checks and final invoice to prove this. Thanks
I have the agreement to cease and desist, along with final notice of outstanding balance- both from the marshall. I then sent payment with a letter, which they cashed two weeks ago.
Did you talk to your employer? What did they say they required to cease garnishment? It's possible they were contacted, and just didn't do their paperwork or that you were just left in limbo. Do they require one particular item that may be missing from your evidence? Was the employer ever contacted by the other party? If not, get right on the individual and document in the time-line how much money you've lost due to their negligence and that you want the money returned. If they refuse to return money they've garnished illegally, you have the option to use the court system on them too. Get everything in writing and don't let the money slip through your fingers.
