Perkins loan rehab

    Hello all. Long story short, 2500 due on Perkins Loan to university. To rehab, ca is requiring something like 500 down payment and 125 mo monthly payment based on 18 month repayment they admitted was a guideline from the school.

    I thought that was unfair, went round and round with them, decided I would pay $50 per month, tired debating with the ca my interpretation of the HEA. Will ask for rehab after 12 months.

    Now for you experts, referring to the Perkins Loan comments from 1999 link:
    http://www.ed.gov/legislation/FedRegister/finrule/1999-4/102899a.pdf. Further for those in default with Perkins loans, this document is a must read I think.

    Now in page 7 is says a signed rehab agreement is not required. Page 8 2nd paragraph also discusses the spirit of rehabilitation and mentions it is not to be used to force a borrower to pay the full balance due on the loan in the remaining time left on the original note, much less in the 12 payments.
    This is why I think the 18 month payout is unfair but I don't have a bank of lawyers to challenge the university and have more important things to do than that.

    I'm going to request rehab in 12 months, the university accepted my first check, and I will print an imprint of each. Any opinions on whether the school will have to give me rehab? I'm thinking they will. Since no written agreement is required, it seems they have to. Who is to say who agreed on what amount, ca's with dozens of reps, a different one everytime, and all that red tape?

    You do not have to make a down payment, and the rehab is suppose to be only 12 monthly payments. The requirements I have read regarding payment amounts are, the payment has to be at least $50 a month, and large enough to pay the loan off within 10 years. Currently I am rehabing a Perkins, Loan balance was about $1,800. I am making $100 payments. They sent me an agreement, but basically it was a form and they filled in the payment amount based on what we agreed on. I would contact the university's collection dept., and educated them on the laws.
