Permisible purpose or not?

    Hello,

    Recently I sent EMCC an ITS letter because they were reporting an account and they never sent me validation for. Well the account was removed off of my TU report about the middle of last month. I sent TU procedure request and EMCC never responded to it so TU removed the tradeline. Well I pulled my TU report this morning and EMCC did a hard pull just a few days ago and it has "pemissable purpose" next to the inquiry.

    Do I have a case against these creeps?

    I'm not sure who is confused, Is it me or is it you?
    When you send a procedural request to a cra, the creditor/ca is not the one who is to respond to it. The cra is. Further, EMCC doesn't need to validate before reporting, UNLESS, you sent validation prior to it being reported.

    As for EMCC pulling your report, if they still have not validated the acct, then they do not have PP to pull your report.

    Sorry I should have been more clear in my post. I had disputed the EMCC account once and it came back verified from TU. I then sent TU a procedure request and they sent me back a form stating that EMCC never responded to the dispute, so basically I just caught TU just being lazy and not even investigating the account. Nevertheless TU deleted the account. And EMCC pulled a hard inquiry a few days ago and has failed to caugh up validation 3 times..

    Ok. The answer is still the same. No validation before pulling report = no PP.
