Petition for Indebtedness

    Hello everyone,
    I have been lurking for a few days and I have searched on the forum and can not find info or answers to this question. I was served on May 21 with a "Petition for Indebtedness" from a lawfirm, hired by Midland Funding. The cc that they are suing me for is one that I have never owned or used, "Newport News", in the amount of $5,xxx. I pulled my credit report and it shows that it was indeed added to my report in May 08 for an original debt from 98, with a last activity on 6/2003 and is owned by Midland.

    I am writing a letter of verification and sending it by certified mail & filing it with the court documents. My next step is a sworn denial, stating that this company and amount are not my debts.

    I had my purse and billfold stolen in Jan, 2003 and although I had checks written on my account by the thief, I do not believe they could have charged or made any debt by June, 2003. Do I need an attorney or do you think that by doing these steps I will be covered?

    So sorry to hear of your situation.

    You need to file a police report ASAP, also vist Federal Trade Commission - Home to fill out an ID Theft Affidavit.

    Then contact the credit reporting agencies to activate a fraud alert. Contacting one should automatically notify the others.

    You can also add a victim statement to the credit report stating that you are victim of ID Theft to please call (phone #) to verify identity before extending new credit.

    You need to take a copy of the police report and the affidavit to court to show the judge that you where in fact a victim of ID Theft and to have the case dismissed.
