Should I send PFD letter, from CA, to CRA's for more rapid deletion? Or will this just cement the fact that I owed the debt and they won't remove it?? Thanks.

Can you be a little more specific? What is a PFD letter? What does it say?

    Pay For Deletion.

Here is the text of the two letters I received from the CA.

    1. Our office is in receipt of letter dated 02/17/04 in which you authorized our company to charge your credit card to pay in full the aforementioned account.
As stated, our office will delete this item from your personal credit profile, as you requested.

    2. To Whom It May Concern,

The above referenced claim has been paid in full.

We are under instructions from our client (the original creditor), to remove our tradeline from the credit profile of the above party.

    M. Leonard and Assoc. is not responsible for the credit bureaus' response times in reflecting this update.

The FCRA and FDCPA apply REGARDLESS of liability of a debt.

They letters are nicely worded, but they are still screwing you!

"1. Our office is in receipt of letter dated 02/17/04 in which you authorized our company to charge your credit card to pay in full the aforementioned account.

-Was the collection agency listing the account on your credit report?? IF so, you are still left with the original creditors entry.

"2. To Whom It May Concern,

The above referenced claim has been paid in full.

We are under instructions from our client (the original creditor), to remove our tradeline from the credit profile of the above party"

-The original creditor cannot "force" a collection agency to do ANYTHING with their entry. This "agreement" is ONLY between you and the 3rd party collection agency. IT DOES NOT SOMEHOW bring the original creditor in as a party to the agreement.

-Sending these letters to the credit reporting agencies is a MUST do. Send a DISPUTE to the reportin agency DISPUTING the STATUS of the enrty NOT IDENTITY, and include the collection agency letter. (copies)

Thanks for the reply. The OC is not listing these accounts on my credit report. However, the CA account is still showing on TU and Exp (with 2 different balances). My questions are these:

    1. How long should it take for CRA to update (if in fact the CA did delete?)

    2. By submitting the letters, will it only cement the listing to my CR because I paid them? Ie. the CRA's verify as paid and balance goes to zero, but leaves the collection on my report.

    3. If I do submit the letters and the CRA's only update as paid vice delete, do I have any recourse, as the agreement with CA was for deletion?

Thanks in advance for any further assistance.

    From a preacher in California

    >As some of you may know, one of my son's serves in the military. He is
    >still stateside, here in California. He called me yesterday to let me
    >know how warm and welcoming people were to him, and his troops,
    >everywhere he goes. Telling me how people shake their hands, and thank
    >them for being willing to serve, and fight, for not only our own freedoms

    >But he also told me about an incident in the grocery store he stopped at
    >yesterday, on his way home from the base. He said that ahead of several

    >speak out so loudly and clearly , I'll gladly pay your way back to Iraq
    >so you can straighten out the mess you are obviously here to avoid."

-IT only takes 30 days :) The time period after they receive YOUR dispute with a copy of the PAID letter :)

-The collection/reporting law apply REGARDLESS of the status of the debt. IT would not be suprising if the CRA verifies the account. IT IS YOUR ACCOUNT :)

-THATS WHY YOU SEND A DISPUTE TO THE "STATUS" OF THE ACCOUNT WITH A COPY OF THE LETTER FROM THE CA.

-IF YOU DISPUTE the account, sending a copy of the letter, they are required to "investigate" including "taking into account any and all relevent information provided by the consumer." IF THE COLLECTION AGENCY verifies the "Status" and the CRA "verifies" it in your report, THEY CAN BOTH BE IN VIOLATION OF FCRA 623 (b).

-The CRA can use its own information to delete the account (the letter)
