Had a charged off account on all 3 CRAs. It started with one OC, then started showing up with an additional OC and an amended account number on a couple CRs(yep, two OCs at once). Disputed it and two CRAs deleted (whoohoo!!!). In Sept, a CA dings me with a Hard inq and about a week later I rec'd a CA notice. I'm mailing the validation letter tomorrow. Here's the fun part - the third CRA has verified the second account Twice - no listing for the original. So for kicks, I tried to register on the OC's website for online access to the account with the info from my CR. No luck. So, I called the alleged OC and, would you believe it, they don't show an account in that number or Any account by my SS # (pretty nervous phone call, thinking I might wake the sleeping giants). Now for the Really fun part - on the CR, it says "purchased by another lender". Huh... another lender??? The OC "can't" send me anything showing that I don't have an account with them, so I'm a little befuddled about where to take this now. The account is still in investigation with the CRA (3rd time), so maybe I'll get lucky this time. I'm almost tempted to just call the CA but I want to see what they can come up with for validation. Calling the CRA now to see what I can do about this....
Yea! Maybe they will verify AGAIN! That would be the lucky thing for you...why...because this is a slam dunk and you are building your case having this "phantom" account verified so many times...send a procedural request next...get them to divulge who they spoke to, and how they verified. Then sue the CRA for verifying an obviously unverifiable account 3 TIMES! And how you have been denied credit several times because of this damaging entry. (remember to apply for a card you will be denied for). I guess you would REALLY be lucky either way. If they delete, it is gone and you have good credit for the holidays, horay!!!...If they verify, you sue and have $$ for the holidays, horay!!! -Peace, Dave
CRA's response - "you need to take that up with the OC". Couldn't see that coming, eh? So, I asked the rep how they verify this information when we dispute it. "It's done computer to computer", which leaves me wondering Which computer they received the information from. Oh, the account shows "Updated" on the CR. Apparently, computers are capable of responding with, "Sure, I guess that sounds about right". I sent an e-mail to the OC and explained the situation to see if they could provide something in writing. The dispute has about a week left so I'll see what they come up with this time. I also deleted all my previous addresses to see if that would help. Anybody have any experience deleting an account that can't be found? Is there a financial DNA test I can take for this? lol
Hi Nave In a previous post You said: "Yea! Maybe they will verify AGAIN! That would be the lucky thing for you...why...because this is a slam dunk and you are building your case having this "phantom" account verified so many times...send a procedural request next...get them to divulge who they spoke to, and how they verified. " Have you had success with this? I have been trying to get TU to do exactly that and they flatly refuse to tell me who at Sallie Mae keeps verifying inaccurate information. They tell me they don't know and give me a phone# to call Sallie Mae.
Hi jlava, From the FCRA: § 611. Procedure in case of disputed accuracy [15 U.S.C. § 1681i](a)(6)(b) (iii) a notice that, if requested by the consumer, a description of the procedure used to determine the accuracy and completeness of the information shall be provided to the consumer by the agency, including the business name and address of any furnisher of information contacted in connection with such information and the telephone number of such furnisher, if reasonably available; Send TU a letter and demand they provide you with the information you are entitled to under the law. There are procedural request letters in the sample section. That said, I have heard others with similar results as you have had, where the CRA's flat out ignore this part. But it IS in the FCRA and they ARE required to send you this information or they have violated your rights under this act. Period. (notice the word SHALL above, not may, or should, but SHALL) -Peace, Dave
