I am so mad at these bastards. My first dispute ever and they reaged my damn accounts!! So I wrote these dumbass bastards a letter. Based on the posts here everyone is giving them chance after chance to comply with the laws. 30 days here, 30 days there, next thing you know its 2 months down the road and you're still in the same spot. But I AIN"T letting um do that to me. I've learned here from the creditneters that these dumbasses just don't care. So I wrote them a letter, it goes a little something like this:

    March 25, 2002

    Experian

Re: Blatant Violations of the FCRA

    To Whom It May Concern:

On February 24,2002 I requested an investigation of the following inaccurate data contained on my report #0859148802 dated February 22,2002:
    1. XYZ Company, acct#105000â?¦, status: Included in bankruptcy, scheduled to continue on record until 12-2006
    2. XYZ Company, acct#105000â?¦, status: Included in bankruptcy, scheduled to continue on record until 12-2006

Upon conclusion of Experianâ??s inept and ludicrous investigation, you now report the following on report #2873311636 dated March 22, 2002:
    1. XYZ Company, acct#105000â?¦,bal $986.00, status: Account charged off, scheduled to continue on record until 3-2009
    2. XYZ Company, acct#105000â?¦, bal $5784.00, status: Account charged off, scheduled to continue on record until 3-2009
    3. ABC Company, acct#773000â?¦ bal $265.00 scheduled to continue on record until 7-2007 (Note: This particular item I did not request an investigation on and it WAS scheduled on record until 5-2002 per your report#0859148802 dated February 22,2002. But look at it now, some idiot re-aged it!)

These results of your inept and preposterous investigation dictate your flagrant disregard and willful violation of the very laws that congress enacted, via the FCRA, to prevent and prohibit this very practice of RE-AGING consumer reports. The FCRA has been very clear and adamant about this issue of re-aging. Experian is in violation of the following:
    § 605. Requirements relating to information contained in consumer reports [15 U.S.C. § 1681c]

Per your willful and purposeful actions, you are liable to me amount of $1000.00 per violation.
    § 616. Civil liability for willful noncompliance [15 U.S.C. § 1681n]

Upon receipt of this letter, and within 7 days, I demand that you delete, in its entirety, the above inaccurate and incomplete information contained on my credit report. This is not a demand for re-investigation as you have proven by your own negligent actions that these items cannot be verified and is therefore deemed inaccurate.
    § 611. Procedure in case of disputed accuracy [15 U.S.C. § 1681i]
    (5) Treatment of inaccurate or unverifiable information.

Failure to comply will result in the filing of a small claims suit in the amount of $3000.00, in the city of XXXX, state of XXXX, and County of XXXX citing Sections 616 and 617 of the FCRA on April 12, 2002.
    § 617. Civil liability for negligent noncompliance [15 U.S.C. § 1681o]
    § 616. Civil liability for willful noncompliance [15 U.S.C. § 1681n]

Enclosed you will find copies of the following:
    1. Credit report number 0859148802 dated February 22,2002
    2. Credit report number 2873311636 dated March 22, 2002
    3. Small claims suit in the amount of $3000.00 dated April 12,2002
    4. Copy of complaint to FTC

    Sincerely,

    XXXXXX

What do you think? Will it work? I'm really pissed and I'm laughing at the same time because I can't believe these idiots. It just doesn't really hit home until it happens to you. I feel all of your pain.
