Hey Guys, I sent a validation letter to EMCC and they signed the green card on 1/21/03. Well they sent me a bill for the debt that was dated 1/28/03 without sending me any kind of validation that I had requested. VIOLATION #1, I just get home from work and they have sent me a nasty letter stating that if I dont pay the full amount, that they will take legal action me and will seize personal property, garnish wages, yada yada yada If I dont respond within 10 days of receipt of the letter. VIOLATION #2 (trying to collect again) I cant believe these guys!! Is thier any way that they can weisel out of the fact of me sending them a validation letter on 1/21/03. I have a copy of the validation letter and the signed green card from them, but could they lie and say that the copy of the letter that I sent them wasnt what I actually sent them? It makes me think that they are up to something. I mean can a CA really be that stupid to send me 2 different bills before validating the debt to me?? It just seems that their might be a loop-hole that they can ooze out of. And I stress the word "ooze" Do I have a leg to stand on here? I am almost positive that the SOL is up on this debt. But they wont provide me any proof of the debt, so I cant be 100% for sure. They have exactly 11 days left to validate. But I would like to take all of my violations on them (and I have around 6 written violations) and burry these freaks for good. or should I swallow my pride and wait out the 11 days??? HOLD ME BACK!! I copy the addressed Certified Receipt and Green Card onto my letter before going to the PO. Then I attach the original receipt post marked by the PO and the returned green card to my letter. Hopefully this xtra step will keep them from saying something else was sent. Tuit

You should most definitely wait for the other 11 days to pass before doing anything more. Do what the law says to do. Give them the time that the law says they have and just ignore anything else they do in the meantime but keep records for future use. At the end of the 11 days then take whatever further action you plan to do at that time. As a general rule you should heed the word of Admiral Farragut while fighting the enemy in the swamps of Louisana or Florida or wherever it was he fought. At any rate he is quoted by one or more historians as having said "Damn the mosquitoes, FULL SPEED AHEAD!" Er somthin like that anyway. (LOL)
