A collection agency has entered duplicate TLs for the same deliquent phone utility account. They just added some numbers to the original "account number." I requested validation on this account, 30 days later sent another validation request, 15 days later sent estoppel. It's now been 30 days since estoppel. What should I do now? Since they have made up another account, it is making it very confusing and difficult for me to address the original TL. Has anyone else had this experience with a CA adding a duplicate account? Do I need to send the same letters with the different account numbers, or is there a good way of writing a letter to them to address this situation. I also disputed with TransUnion and they both came back as verified today. thanks in advance for your help.
What steps did you take to do this? Did the CA remove them or the CRA? TransUnion said they could not delete, even the DOLA, amount due, and account numbers (with the addition of about 5 numbers) are all the same... I have disputed with both and they won't remove at least one of them.
Could someone direct me to a sample "ITS" letter. The minimum I wish to accomplish is: 1. Get duplicate CA removed from TransUnion. 2. Correct the DOLA from 6/2000 to 1/1998. Ideally, of course, they will both be removed from TransUnion. I have heard horror stories about American Agencies. Has anyone else had experience with them? thanks.
If you are going to sue American Agencies, do it quickly . . . last I checked, their corporate status is suspended which means that they cannot defend themselves in court. Of course, they can bring it up to date at any time. (They've been suspended for quite a while, although in mid to late December it did show as active for a short time.)
If what merlin is saying is true currently, I would skip ITS altogether, and file at the local magistrates, or small-claims court now. Since you want to hit them while they are still suspended, any delay could allow them to try to become active again. Your confirmation from TU that shows that both accounts were verified is your documentation for the violation. FDCPA "reporting false and misleading credit information" would be the one violation.

If the Corporate Veil is down, then there IS no corporate entity for them to hide behind. Go after their PERSONAL bank accounts and wages, just like their bill collectors do.

Re: Re: Re: Please advise Small Claims Court is a very layman-friendly place. The clerks usually are very helpful and in most cases attorneys are not allowed. The procedure varies from state to state. Here in Pima County AZ I can file the suit on line. It costs $19 here. The Court sends the summons to the defendant and then enters the receipt of teh summons in the Case file which I can check on line. Eventually the case will come to the Trial Calendar and I go to the Court to tell teh Judge my side. I bring whatever documents and witnesses I have and go from there. The decision is usually mailed within a week.
