Please help!! Added neg info!!

    I really need some good advice because if this is not corrected I do have a good chance to sue.


    Two months ago I disputed an account on my hubbys report from Summit bank as "not mine". It had three thirty day lates on it from back in 2001. It came back a month later as verifyed with Equifax. It turns out my husband had gotten the loan from Summitt in 1999 but Summitt sold the auto loan to Fleet bank and we are paying Fleet presently on that auto loan.

    I checked my husbands Equifax Fico again last night and Summitt and /or Equifax inserted three unknown late dates to the Summitt bank account . One for 30 days and the other for 60 days in addition to the three thirty day lates. Not only was I not notifyed of the change at all let alone in writing, but the dates are UNKNOWN and they were added over a year after the loan was sold to another company.




    That is outragous!!!!

    I need to do this right guys. What part of the FCRA has Equifax disregarded? Does the reinsertion provisions apply since it was not a matter of reinsertion but of ADDING FALSE INFORMATION!!!

    Did Summitt bank break any laws as well?

    I have a copy of a May 2002 credit report listing only the 3 , 30 day lates.

    I have a copy of the present report listing the unknown lates.

    I also have the letter that verifyed the account was his back in June which does not mention any addition info was inserted into my file.

    Anything guys? I am very upset about this despite my joy that adding my husband to my CC account made his score jump from 606 to 629. I know these unknown false lates are affecting his credit and I am disturbed bcause it sounds as if it could have been deliberate.

    I'm not well read enough on the FCRA to recite provisions off the top of my head but..

    Why don't you dispute with Equifax, call or write them to find out why this was inserted. Perhaps Summit when they verified submitted the additional late payments. However, why would they be unknown dates?

    Since the account wasn't deleted though, I would think that Equifax wouldn't have to notify you.

    Did the Summit account list as open before or as closed/transferred? How is it listed now..in terms of status?

    It Summitt is listed as "Account transferred or sold auto".
    but......

    on the credit report from May it lists date of last activity as June 2001.

    on the present credit report it lists date of last activity as July 2002 and this is obviously when they inserted the unknown dates. The activity was not OUR activity but Summit adding info.

    The investigation was completed in June and June 24 I recEIved the Letter from Equifax stating that it was a verifyed as his account.

    bottom line is "Can they report UNKNOWN dates" ? How can they verify unknown dates?

    Well..correct me if I'm wrong..but you haven't asked EQ to verify the UNKNOWN dates b/c they were inserted AFTER your dispute, right?

    As for the DOLA, then doesn't that mean that the account is being reaged and isn't THAT illegal?

    I know that I've read a few posts about the unknown date issue. Can't remember them off the top of my head...have you tried a search?

    Yes correct, the unknown dates were inserted a couple of weeks "after" the investigation so I would not have known about them to dispute them.

    Also, I am unsure if when Equifax reports the "date of last Activity" if it means activity by the creditor or by my husband? It certainly was not activity by us. It was a sold account over a year ago. We make no payments to them nor do we owe them money.

    How will I know if it reaged?

    I believe that activity can be ANY activity...i.e. a company charging off what you owe would be considered activity. Others..feel free to chime in if I'm wrong.

    As for proof of reaging you said you had a copy of the old credit report, correct? And a copy of the new? That would be proof since you have been paying Fleet ever since 2001 and so how could there have been activity in 2002? They didn't own the account. I would definitely write letters to Summit and/or Equifax asking about the reaging and the addition of derogatory information.
