Please Help! convert CH13 to CH7

    When you convert does the CH 7 entry in the Judgement section of your CR reflect the date you filed your CH 13? Or is it a fresh date listed when you filed CH 7? And does your lawyer use all your paperwork from the CH 13 or do you fill out all new schedules? I would imagine you do. Curious about the last question, because there was some misspellings done on my name and this caused my CH 13 to hit only one CRA so I would like to keep the mistake going. By the way I didnâ??t do the misspellings myself the court did and I didnâ??t notice until I looked it up using Pacer a year later. All comments appreciated.

    1. Depending on the local Federal court rules, there is probably a standard form to convert from Chapter 13 to Chapter 7 that your attorney will fill out. The original Chapter 13 schedules may need a small amendment, otherwise the original schedules will probably be used.

    2. It is likely - ( no guarantee ) - that PACER will not correct the name spelling mistake.

    3. The cra judgment reporting date is the date that the judgment was entered by the court.

    thanks for the reply, so do you know if the CH 7 date will the same as the CH 13 or is it when the conversion takes place? Ex. if I filed CH 7 today the file date on the CH 7 would be today. I had heard somewhere that it would reflect the date I filed CH 13 in 2002.
