I Have a question regarding something that happened to me.

I joined a gym and due to me getting a second job I never had a chance to go anymore. I talked to a girl that worked there and told her my situation. The employee told me there would be a cancellation fee and that she would take care of it. About a year later I received a notice stating that I had not paid my bill in three months. The company was apparently charging my bank account every month and i wasn't aware of this so my membership was never canceled. It was initially on my current boyfriends discover card then I switched it to my visa debit however he was the one that was sent to the collection agency not me. The gym only had his name and card number for three months tops but everything from my address to my social was in my name. I called the credit agency about the whole discrepancy and I was told that even though I was told by an employee that I was terminated by their gym they could not help me. I was also told that even though it was a membership for me it was on my ex -boyfriends credit. So do I have any recourse with the fact that the account is going to his address with his name but my social?. My boyfriend just received a letter from a collection agency (Merchants Interstate). What should we do, aside from sending a letter before the 30 day period asking for verification of charges? I would like some advice on what I can do to better the situation I'm in.

    Thanks for any help!

    Melanie

Most certainly you shoud send the validation letter to the collection agency. What else you can do is going to depend to some extent upon what state you are in. It would be helpful if we knew that.

I am in California. Do I have any grounds to dispute because of the name not matching the social security number?

    I wouldn't advise it.
