Please help with 1st Premier ChgOff

    I have a First Premier charge off on all 3 CRs that I am trying to dispute. It was opened 7/2000 and DOLA is 4/2001 on EQ, 2/2001 on EXP, and on TU it shows that it was charged off 1/2001. It shows a balance of $462 which it says is "past due". It also says it is 90+ days past due 22 times. I have disputed with all 3 CRAs and it has been verified on all of them. The last time they updated was 1/2003. My questions:

    1) Can they continue to report it as past due and keep adding how many months past due it is? (i.e. 90+ days 22 times, 23 times, 24 times...)

    2) All three CRA's clearly have different dates for the DOLA and date it was charged off. How can they all three be verifying and reporting different info?

    3) Does the OC have to mark an account as in dispute on my credit reports when I dispute it?

    How would you approach this?

    First, did you validate with the CA? If you didnt, send them a validation letter. Send it CRRR. Once you get the green cards back, dispute it with the CRA. And yes, the CRA has to report it as in dispute if you in fact dispute it.

    No, they haven't sent it to a collection agency.

    There is obviously inaccurate information being reported, because all CRA's are reporting different dates and balances... so how could they be "verifying" it? Should I dispute with First Premier and try to have it deleted by using violations of the FCRA as leverage?

    You could try a written dispute and use " I have never had an account with First Premier with a balance of XXX.XX." This worked for me with Capital One which is normally one of the hardest TLs to get removed. Also, I say this all the time, but get all your previous addresses removed. This makes a huge difference if your previous addy is associated with the negative TL.

    Well, if you start writing the OC directly, you will probably wake them up to restart collection attempts. Are you prepared for that?

    I will try that and see if it works. (I have a Cap1 also and I haven't even tried to get that one removed. The balance on the Cap1 is $1100, so I am kinda afraid to go after that one just yet.)

    jlynn - I could pay it if they wanted to pursue it. In fact, I would offer to pay for deletion. I just want to approach it in the best way I can to try to get it deleted. If all else fails, I will just pay it.

    My charge off was close to 2k and still within SOL and it was removed. Of course I know they can still come after me.
