Please tell me if you guys agree with how I understand my current situation. I have a studen loan with Sallie Mae. In June 2003 I was 120+ days late. I called and applied for a forebearance/deferment. I was granted a deferment back dated to October 2002. Same thing as above with ACS Student loans. Both companies were reporting the lates to the bureaus. I called both and requested the remove the lates as they were reporting. ACS removed and has never re-reported again. Sallie Mae removed. HOWEVER, just recently they have begun re-reporting the information and refuse to remove teh lates stating it is agains the FCRA and crap. The lad y with customer service went on to state that the report was correct and my forebearance agreement (which specifically stating I don't have to make payments during this period) has nothing to do with reporting. They willcontinue to report that I was late. Now I interpret the deferment agreement to say, You don't have to make payments. Therefore isn't a double edged sword to report to the bureaus I was late making payments if I have an agreement stating I do not have to make payments? All advice is welcomed, as my scores are in the low 500's.
I had a similar issue with my student loan. I would have told the lady on the phone that it's against the FCRA to report FALSE information and you have documentation that proves they are reporting inaccurately. Try calling "cusomter service", request a supervisor and say "look, I have a deferment letter that states I did not have to make payment begining with X-date. You are reporting that I was late making payments, when in fact, as per your letter I did not have to make payments." I would further explain that this information had been adjusted once previously already and REINSERTED improperly without your notification. In addition, this false information is jeopardizing your financial abilities. I would continue to explain that if they do not correct the information you are going to contact an attorney. (I did this and within a matter of days the whole negative tradeline was gone)
