During the middle of June, I moved into my home in California, and at that time, had all of my mail forwarded to the new address. I left open my one checking account that has branches only in the midwest. During the time from my move to the middle of July, eBay was charging my account balance to my checking account b/c the credit card number on file was coming back declined (because I changed the billing address). The problem is: I left only a $100 or so in the checking, and the eBay fees were $135 or so. The bank returned the transaction each time it was presented. All in all, $776.25 in overdraft fees accumulated. My first notification came to my new address 7/18. The bank charged off the account 7/14, leaving me no time to rectify. I immediately sent them an official check for the $776.25, but the manager said they won't delete off chexsystems. Obviously, I am in a good position to dispute, but what should I put on the Chexsystems dispute form? The debt is technically valid, but completely unethical to be reported. Also, by the time I received notification from the bank, it was too late. They said they mailed and called for 30 days. I received NOTHING before that point. I already have a current report and am ready to go. Thanks for the help-DD

I received that response from the bank after I paid. I would have paid it anyway; after all, I didn't switch the CC info with eBay. But it's the fact that ChexSystems is supposed to reported intentional mishandling of accounts, etc., and my situation was certainly extenuating.
No guarantees, however, I would try the following: First, dispute it with ChexSystems. Wait a week after sending the ChexSystems dispute, and send a strongly worded letter to the bank's branch manager or the Loss Prevention department where your account was handled. Explain in detail the eBay transaction mishandling and request removal from ChexSystems. (If you have any type of written documentation to support eBay's actions, that may help strength your negotiations) If the bank verifies with ChexSystems and will not remove the listing, I would send a complaint to the state banking regulatory agency where the branch is located. If the bank is a national bank, send the complaint to the Federal Office of the Comptroller. If you file an official complaint, send a certified copy of it to the branch manager or Loss Prevention Department.
