I don't what to do next. This is still regard an account that MBNA opened for someone using my husband SS# but they sent the card out of state that never belonged to him. MBNA never sent anything to prove that it was his, they just called and wanted to get paid. They said the account was opened 5/01 and last activity was 8/01, and it was maxed out in two months. We have no idea where the charges were made but they said it was all cash advance. MBNA charged off the account and it has made the rounds to several collection agencies, We have sent CRRR validation to the 3 collectors but have never received anything back from them. Midland credit management has it now, I requested validation from them 9/29/03. Their tradeline is on his credit report since 9/03. They have reported this on 9/03 - 1/04. We disputed as not his last last month and Midland credit management verified it. Do I send another validation letter to them or demand that it be removed because it has never been validated as his? Sorry this is so long but I am about to lose what little mind I have left. Thanks
You need to send the validation letter to Midland by certified mail return receipt When you get the green card back from the post office you need to dispute the Tradeline on all of the Credit reports it shows up on If Midland verifies the information with the CRA's and does not send you prper validation, you will bew smiling because then you have them on FDCPA and FCRA violations which will be money in your pocket!
I sent the validation request, CRRR and they never validated. What I need to know what is the next step and do I have anything to file on them since they did not valiidate. The MBNA was deleted from his report, last month. But now this is showing. Please help! It looksl like they verified to credit bureaus for about 3 months plus they pulled hard inquiries on all CB when they bought the account. When we talked to them, they were told that we had never had that address and they had no PP to pull a hard inquiry. We have been going through credit card HELL For almost three years, we have always paid all ours bills on time. It is very seldom that we have a balance on any credit card . Because of this MBNA account we have had our interest rates raised and been turned down for loans. This has to stop, do consumers have any rights anymore? Iam sure this collection from Midland credit will effect our credit even though, this is not ours. What do I DO NEXT?

Today I went to the post office and had a letter demanding payment, from Midland Credit Management. They sent what looks like bills addressed to the address that MBNA sent the credit card. The bills were for 1/02, 2/02,and 3/02. When I requested validation, I asked for the application and all charges made to that account. I know this is not validation! All that it shows is over limit and past due charges. Could I get the credit bureau to delete because it is not my address, if I sent them a copy of ths statements?

Thanks! I need a letter to send them that they didn't validate and the tradeline must be removed. Can I do that? Also can I demand the the CRA remove since This is not his account. I am about to lose my mind. We have gone through creditcard hell for nearly 2 years. The account would have rever been opened if MBNA had take the time to call or write a letter to the only address that was on our credit report. I just don't know how to get it stopped.

Assuming you can open PDF Docs., here is where you go to get the Fraud Affidavit you and I spoke about; http://www.ftc.gov/bcp/conline/pubs/credit/affidavit.pdf The correct affidvit is this one, not one you make up on your own. Print that out. Fill in the boxes, and have your bank notarize it. Then go see your Sheriff and have him throw togther a quick police report. I know he doesn't "want" to, but that's irrelevant. Just tell him you don't care about an investigation, you just need the report to clear your own name. Once these steps are complete we'll talk again for the next steps. Let's get busy. .
Contact MBNA and request to speak with their FRAUD department. Explain to them an account in your husbands name was opened and you need their assistance in clearing it up. This is a matter for MBNA - not collection agencies.
Everyone is being a complete arse at the credit bureaus and the CA and OC's. The Fair Credit Reporting Act was amended very recently to include provisions for the blocking of information resulting from ID theft. By doing what butch said you can force the CRA's to block the reporting of the information within 4 days. All ya gotta do is send them a fraud affidavit, police report, and identify what informaiton is on your reports as a result of the ID theft. That includeds all CA's, OC's and INQUIRIES.
