I am writing this letter. I don't recall applying for credit or employment with SillyCA. Based on your fax dated 10/08/03, you also state that SillyCA has no record of anyone with my social security number applying with you. In any case, two inquiries appear on my credit report from SillyCA from 7/02/03. On 7/11/03, I sent Amricredit a certified letter (attached for your review); return receipt to SillyCA - 801 Cherry Street #3900, Fort Worth TX 76103, which was signed for by J, DeLonais. I received no response from SillyCA. On 10/03/03, I called sillyCA and requested to talk to a manager; I was transferred to SillyCA manager (No last name given) who said she would send a Universal Data Form to correct the errors. Then I received a call later that day and was told that SillyCA could not send the form but that I needed to dispute it with trans union. As you are probably aware, the credit reporting agencies regard inquiries as a statement of fact and will not allow a consumer to dispute them. They maintain that if the inquiry is on file then the company listed did in fact view the consumerâ??s record. On 10/8/03, I called SillyCA and asked for the legal department. I was transferred to SillyCA person, who was quite helpful. Shandra took my information and called me back with a plan on how to get the invalid inquiries off my report. On 10/8/03, SillyCA person requested that I fax a letter to SillyCA stating that I did not authorize any inquiries so it could be forwarded to Trans Union for deletion. As of today, 10/10/03, the invalid inquiries still exist on my current report. Be advised that at this time, I can clearly show harm done by the misreporting on my credit report and will not hesitate to pursue necessary legal action, including at a minimum, $2,000 for SillyCAâ??s non-permissible pull credit violations. As a settlement offer, I will accept a check in hand for $1500 and complete removal of both inquiries by 10/17/03.
