I have two med ca's (same ca) on my Experian report, one has just gone out of sol for texas and the other will do so in May. They are both about 250.00 apeice. I had insurance at the time they occurred and insurance was to pay the balance they state I owe. I have disputed these with the CRA's over a year ago, I got them deleted from Equifax & Transunion but Experian verified them. I then attempted to go through the OC & the insurance company with no results whatsoever. I tried to dispute them again with Exp & they refused to investigate again. I have not heard from the CA at all but they have set up camp on my Exp report and won't leave. I have a utility CO through TXU for 120.00 on Exp too that I have haggled and haggled with to get removed & they won't budge. I say I paid the final bill they sent & they say 120 is owed. It will be out of sol this year too. I had thought to wait until all 3 accts goes out of sol and then DV the ca & TXU. I doubt seriously they will even answer the DV & hopefully I can kick them off that way. But...... Is DVing after they reach SOL my best option? At this point are the CO's hurting me worse scorewise than the TL history is helping? And they are only present on Exp. I haven't pulled Exp FICO but I beleive it's in the upper 600's prob around 660-670 if I had to guess. The only other baddies are my Chap 7 from 2002 and the IIB accts. What is the length of time they can stay without any intervention? 7 years? If so they will fall off in about 3 years. Just wondering if I should go through with the DV's as planned or leave them alone? I had to recently take a break from these buggers because I got so burned out fighting them. Thanks, Tegleg
I have been thinking maybye another route can be taken. Listed below is how these accts appear on my Experian report. Anything look like a violation maybye? Thanks to anyone who looks! I appreciate any insight on these buggers, I have tried & tried with no luck... Tegleg
Check Why Chat's stuff on medical. HIPAA may be your friend. As for the others, why not DV when they're out of SOL. You seem to have other credit. It will have seasoned by then. Old collections and COs can help your score, but they also are barriers to getting really prime credit ... credit that might be available to a lower score with zero derogs. For that matter, why not try disputing off that BK?
I did go the hippa route with the med ca's and after sending the one with the insert b (I beleive it was b because it was paid by insurance, I don't have my copies handy right now but I paid alot of attention to make sure I did it properly) and got no reponse to anything. Very frustrating! I guess I will need to DV them all after they are SOL and followup with another dispute with Exp. Uggggghhh. Or I could only rely on my Transunion & Equifax scores lol. On reviewing my reports each of the bk's seem to have some kind of inaccuracy. Except the devil Experian. If I were to dispute based on that would'nt I still get dinged from some of the older TL's that state IIB? Thank you! Tegleg
You're in Texas, apply the TFC. Request validation, they must answer. If they don't answer, consider instituting a civil action against them under the TFC and Experian under the FCRA for failure to maintain reasonable procedures to ensure the maximum accuracy of your reports; i.e., allowing inaccurate information to be verified over and over. Of course, you will need to determine whether it is worth it and whether you can prove up damages for the FCRA claims.
I think I have a plan: I have been researching Whychats information concerning SOL accts. After all 3 are entirley out of SOL 1. Send predispute letter to Exp. 2. If no response or refusal send SOL letter to CA & TXU. I think this will be my best chance at deleting them. Still pondering the bk question, On reviewing my reports each of the bk's seem to have some kind of inaccuracy. Except the devil Experian. If I were to dispute based on that would'nt I still get dinged from some of the older TL's that state IIB? Do you have to remove those too? Thanks! Tegleg
