possible suit?? Know you enemy!

    I just wanted to bring about an important issue as it may help others who are trying to bring about court actions on CAs, OC's or CRAs.

    I have found it to be successful and it may work in your favor.....

    Know your Enemy!! Gather as much information and intelligence you can before filing suit or if you have already begun your suit.

    This means searching the internet and finding out such things as their Better Business Bureau record, state record or licensing requirements, tax requirements etc...

    Alot of this can be done for free by digging up public information sites. You can also find stuff out for a small fee by going to www.knowx.com and do whatever search you want.

    Find out how many other times they've been sued? What were the reasons? How many times have they lost? What are their financial assests? How many complaints have they had??

    First check with the BBB and get a free report. I did this with one CA and it stated their license had been yanked for too many complaints, failure to adhere to the laws they are governed by and failure to respond to the bureaus numerous letters sent to them about their complaints.

    I made a copy and used it in my suit to prove to the judge, "look your honor, they claim to have mailed me the validation info several times, they have my correct address but I've never received one letter from them in response to proving the debt other then collection letters, their record as I have proof from the BBB clearly will show the way they like to do business with other consumers and how they don't like to repsond to complaints or reply to letters"

    You should have seen the CA rep's jaw drop on that one!!! He said wimply, "Your honor could I please see that??" When he looked at it he said this is not an updated copy and not true about their current status with the BBB. I said your honor can clearly see the date at the bottom of the page and your honor could call this number I have hear and speak to the BBB himself. The judge said to the defendant "Should I give them a call on this or do you still want to argue over this point the plaintiff has made??" He said "No that wouldn't be necessary"

    As you can see above by researching and knowing the enemy this can help your case greatly!

    good job tac. I will use the same stategies on my 1st lawsuit. it will be against Equifax chk Services.
