Hey all, I sent a letter to 5/3 bank on October 23 that was an "oc validation" letter. I sent it certified mail, rrr, but no green card ever came. I put the tracking number in at the usps website, and it only says that I sent the letter, not that it was ever received. I sent the letter to the address listed on my tu report. What do I do, just re-send? Is there anything else I can do?
Any thoughts on how I get them to read the letter if they won't sign for it? If they're going to report my information to cra's, don't I have a right to correspond with them?
yes, but some CRA's out there just won't sign for a certified letter no matter what you do. they don't want you having documented proof of your contact with them. I personally never sign for certified letters myself.. I'd just wait and see..it could be that they only pick up certified letters once a month or something..or the person that picks them up is out of town on vacation. Could be something simple like that. if it comes back to you, try sending it again. save the return letters. that might be ammunition should you take it to court..ie 'i tried to contact them mr judge..but they wouldnt sign for my letters'
Thanks for the advice. I fired off an email to the usps about where the letter might be. If it doesn't come back in another month, I guess I'll just send another letter.
Here is a trick that sometimes works: send the same letter again by CMRRR but on the front of the letter in big letters write: "ATTENTION - ACCOUNTS PAYABLE DEPARTMENT -PAYMENT ENCLOSED" Most companies will sign for such a letter if they believe there is a check inside! Follow-up the CMRRR letter with another letter send regular mail, and request a "certificate of mailing" (cost about 50 cents) from the PO the idea is to build up a paper trail of the attempts to deliver to them

Re: Re: Postal Problem What does the certificate of mailing do for me? My guess is that it proves that I sent the letter, but doesn't prove that they ever received it??? If that's the case, it sounds like my best bet is to send another letter CMRRR, and if they don't sign to send a last letter with a certificate of mailing. That would be a good paper trail. Also, it occurs to me that when I sent a letter to equifax CMRRR that the mailing address was to a PO box. I've got to imagine that green card won't come back either....

Re: Re: Postal Problem Thanks for the info on the po boxes. As far as writing "check inside," or something similar, what happens if they keep the check and present it in a legal setting? I mean, if they're smart enough not to sign, I have to imagine they'd keep the envelope. What do I say to a magistrate, "sorry, I guess I forgot to include the check with the letter that says the account isn't mine to begin with?" I've got to believe that would look bad, or am I being paranoid?

Re: Re: Postal Problem certificate of mailing just shows that you mailed something... the problem is that the FDCPA sets our rights into an when the CA *RECEIVES* the notice, not when we *SEND* the notice, so a certificate of mailing only shows that we sent them something... not when they received it... The caveat in your case, your receipt for the certified letter essentially *IS* a stronger certificate of mailing, it shows when you mailed the letter to the CA with a postal postmark. Also, when you get the letter back, then you have evidence against the CA, if it is marked refused, then the company can't argue that they were never notified, because they refused the notification. This letter is more valueable then gold... You may even be able to file an FTC Complaint against them because they are refusing to receive notices which under the FDCPA are required for them to receive, in order to comply with the law.

I am merely trying to instruct the recipient "To inspect so as to determine accuracy, quality, or other condition" of the contents inside the envelope ... And if the CA fell for the trick, not my fault ... What d'yall say ?

The letter in question went to an oc regarding a paid chargeoff, so obviously the FDCPA doesn't apply, but do you think the FTC would go for a complaint based upon the FCRA? Would it have merit, and why? Anyone with answers, don't be bashful. Thanks for getting me thinking in that direction jam....
