I am being sued by Pressler & Pressler for New Century Financial (owned by Pressler) for approx. $900... We have corresponded back and forth, they have tried to enter a default judgement against me. I wanted to settle with them 3 months ago, didn't hear from them. They entered a motion for judgement and I responded (last week) that I objected to this and wanted to be heard by the court. During the discovery I stated that I didn't agree the debt was mine, and to validate. They sent a computer printout for the end of 2002 for some charges. I asked for a contract between myself and Orchard Bank, the OC.. Got nothing. They said they weren't required... Got a letter yesterday telling me to appear tomorrow in Newark for a hearing.. I can't get there tomorrow.. Does this sound unusual?
Did you ever have an Orchard card? If not then someone else stole your SS# identity, applied for the card, and received it.Those pre-approvals are sent out out by the truck/plane loads, and mail delivery people are known for misdelivering mail. Hell, yesterday my next door neighbor's bank statement was in my mail box.
