    Now THERE goes a visual that I just didn't need from you boys. I was trying to concentrate on credit $$ and now you got me all distracted. ROTFL

    But I do have to beg to differ. I'll give you that some of this is healthy mental stuff, and I'm enjoying that part thoroughly but the namecalling is so kindergarten it truly lessens any potential respect. Perhaps this type of EMOTIONAL debate with namecallin' plays off better in person. But doesn't AT ALL work here...

    Please? Come on now. Kiss and make up. From my front row seat Hiding's displaying his best devil's advocate face for you. I'd think GRATITUDE would be in order here...

    if the opponent cant be ready to answer even off the wall questions...then you are not prepared

    im glad that I am not the only one here who sees it that way and BTW I didnt need that mental picture refering to your MM issue lol

    LK if the Ca takes no stand on the PP do they have a stand with the acct they are trying to collect I think that is what hiding was referring to here.

    if the entire matter was disputed you could sue for misrep and the others.

    just a suggestion if you boys wanna continue with the mental abuse why dont you e-mail each other privately I dont see how arguing your points educates any of us

    I for one just get confussed more and spend more time trying to look for the truth myself elsewhere.

    ( not the boss ) lol :)

    I can see that you take this personally.....YOU WILL NEVER WIN if you cannot remove yourelf from the "case"

    Actually a better question is how many bill collectors would be willing to shell out $3000+ in legal fees to prove us wrong on a $1,000 lawsuit?

    Just think, that money could be used to pay at least one call center employee for a whole month. In that whole month the call center employee could be generating several times their salary in revenue.

    LK, I am surprised you haven't yet told hiding90 to stop being a twit.

    Actually, if push came to shove, I doubt the average pro se would have anything over a 10% chance at winning a case if it goes to trial because the big corporate attorneys are a lot better with procedures... which puts us the plaintiff at a bad disadvantage. However, all those motions and paperwork comes at a hefty price.

    The whole thing that actually gives us the average pro se a chance at getting a little money out of a CA or OC for a weak violation is we provide them an "out" in the form of an opportunity to settle. The fact that we don't have lawyers (and their outrageous fees) makes it possible for us to settle for small amounts and still come out ahead.

    Besides, its a heck of a lot easier to get 3-4 small settlements (meaning under $1,000) than it is to get $3,000 in one pop.

    Basically, there is no way for a OC/CA to win against consumer that has at minimum a colorful argument. Even if the OC/CA wins in court, they have still lost in the expendature of fees.

    This reading of the meaning of the law would render other parts meaningless. (i.e. No pull of anyone's report by a CA would ever be without PP.)
