I received the following e-mail from CMI after Equifax had not only once. but twice "VERIFIED" my dispute. The reinvestigation was through CSC, and it it obvious by this e-mail they didn't even attempt to verify that the information reported was accurate. From: "Sxxxy Bxxxxm" <sxxxxxm@thexxxxxp.com> To: "t man" <xxxxxxxxx@yahoo.com> CC: "Bxxxxx xxxxd" <bwxxxxxrd@xxxxx.com>, "Cxxxx Fxxxxy" <cxxxxy@xxxxxx.com> Date: Tue, 30 Jul 2002 18:43:40 -0500 Subject: Account #xxxxxxxx Mr. T-Man, Thank you for responding to my fax yesterday. I have completed research on your questions. I contacted Equifax on the two accounts you referenced in your e-mail. This has turned out to be a credit bureau error, not a CMI error. If you will notice the reference number is the same on both the accounts (Cox and TCI.) Our client went through several name changes from TCI to Multimedia to Cox and the number assigned to your report is our reference number. There should NEVER be two records on your file with the same account number. Typically these two accounts would be updated as one. As an additional point, I'm unsure as to why the Equifax did not resolve this issue when you disputed with them. The account has now been resolved as I have had the TCI account DELETED from your report. Please use this e-mail/fax as confirmation of that fact. CMI does ensure that correct reporting of accounts are transmitted to the credit bureaus. Unfortunately, we can not be assured that the credit bureaus will always update the accounts as requested; however, please be assured we will always work with the customer to ensure accurate reporting. On the part of CMI, there is no account at CMI in your name for TCI collection of an unpaid balance of $407. The only account we are showing is the Cox account which was submitted to us for $557.16 (which includes equipment.) The equipment was returned on September 19, 1998 which left a balance owing of $136.66 for services. I am unclear as to whether or not you are disputing the validity of this debt. In previous correspondence, which you say in your e-mail you received, CMI has provided you the date the account was opened, social security number used to open the account and the service address as well as the history on the account. Our client, Cox Communications, has also requested that if you never resided at the service address (1124 Fremont St., #A, Manhattan, Kansas) to please provide verification of such in the form or a utility bill or lease so they can take care of this matter for you. I will look forward to hearing from you so that matter may be totally put to rest. Sincerely, xxxxxxxxxxxx Manager of Customer Care The CMI Group 9xx-8xx-4xx1
That's great lawsuit evidence. Clearly Eq violated the FCRA in completing their verification TWICE by responding to you "account verified". Have you applied for credit since this listing has been on your report? Keep all the dispute records and this letter and I would sue EQ for the violations and for damaging your credit. -Peace, Dave
Sounds great to me. I have found that CMI has been one of the most up and up CAs around...I really liked "working" with them.
